[TRYPHONINUS, from the thirteenth book of Disputations.] It must be believed that also that mother is covered by the constitution, who did not request that the tutors given to her impuberal children by the father in a will or codicils not in accordance with law be confirmed by a decree.
§26.6.4.1Sin autem idoneis datis tutoribus pluribus unus eorum uel decessit uel temporalem excusationem accepit, mater, quae propterea in loco illius alium non petit, quia numerus reliquorum administrationi tutelae sufficiebat, incidit quidem in uerba constitutionis, sed sententia excusatur.
But if, several suitable tutors having been given, one of them either died or received a temporary excuse, the mother, who did not request another in his place for the reason that the number of the remaining tutors was sufficient for the administration of the tutelage, falls indeed within the words of the constitution, but is excused by its spirit.
§26.6.4.2Sed si suspecto tutore pupilli accusato decretum erit ei adiungi alios, mater eos quoque petere debet et, si non petit, incidet in sententiam constitutionis.
But if, the suspect tutor of the ward being accused, it shall have been decreed that others be joined to him, the mother ought to request them also, and if she does not, she will fall within the spirit of the constitution.
§26.6.4.3Haec autem mater ab omni quidem bonorum uindicatione intestatorum filiorum repellitur. si uero maritus ei fideicommissum a filio reliquerit, cui mulier non petit tutorem, 'si sine liberis decesserit', uel sub hac ipsa condicione 'si intestatus mortuus erit', fideicommissi petitio, quae ex alieno iudicio descendit, non est perempta.
Moreover, this mother is indeed excluded from all claim to the goods of her intestate children; but if her husband left her a fideicommissum to be paid by the son for whom the woman did not request a tutor, under the condition "if he should die without children", or under this very condition "if he shall have died intestate", the petition for the fideicommissum, which derives from the judgment of another, is not extinguished.
§26.6.4.4Quae autem suspectum tutorem non fecit, nec uerbis nec sententia constitutionis in poenam incidit, quod eiusmodi facta diiudicare et aestimare uirilis animi est et potest etiam delicta ignorare mater, satisque est eam petisse talem, qui inquisitione per praetorem habita idoneus apparuit.
But she who did not accuse the tutor as suspect falls into the penalty neither by the words nor by the spirit of the constitution, because to judge and evaluate facts of this kind belongs to a manly mind, and a mother can also be ignorant of offenses, and it is sufficient that she requested such a tutor who, an investigation having been held by the praetor, appeared suitable.
et ideo nec iudicium eius sufficit ad eligendos tutores, sed inquisitio fit, etiamsi maxime in bona propria liberis suis testamento tutores dederit.
And therefore her judgment is not sufficient for choosing tutors, but an investigation is held, even if she should have especially given tutors by will to her children for her own property.
