[PAPINIANUS libro undecimo quaestionum. ] §26.5.13.prSi impuberi libertas et hereditas per fideicommissum data sit et institutus adire nolit, senatus censuit eum, si impuberis nomine desideretur, adire cogendum, ut tamen pupillo pupillae tutor ab eo, cui ius dandi erit, detur, qui tutelam retineat, quoad restituatur hereditas et rem saluam fore ab herede caueatur.
[PAPINIANUS, from the eleventh book of Questions.] If freedom and an inheritance have been given to a minor under puberty by a trust, and the appointed heir is unwilling to enter upon the inheritance, the senate decreed that, if a demand is made in the name of the minor, he must be compelled to enter upon it; provided, however, that a tutor be appointed for the male or female ward by the person who has the right to appoint one, who shall retain the tutelage until the inheritance is restored and security is given by the heir that the property will be safe.

Afterwards, the deified Hadrian rescriped that the same should be observed in the case of one to whom freedom had been given directly.
§26.5.13.1Quamuis autem a patrono rem saluam pupillo fore non facile cautio exigatur, tamen senatus pro extraneo haberi uoluit eum, qui, quod in ipso fuit, etiam libertate priuauit impuberem: et ius quidem liberti, quod habet, quia ex causa fideicommissi manumittit, non est ei ablatum, tutela uero sine uinculo cautionis non committitur.
Although security that the property will be safe for the ward is not easily demanded from a patron, nevertheless the senate wished him to be regarded as a stranger who, as far as lay in his power, also deprived the minor of freedom; and indeed the right over the freedman which he has because he manumits him by reason of a trust is not taken away from him, but the tutelage is not committed to him without the bond of security.
quid ergo si non caueat? non dubie tutela non erit apud patronum.
What then if he does not give security? Undoubtedly, the tutelage will not remain with the patron.
§26.5.13.2Sed si puella duodecimum annum impleuerit, tutor desinit esse: quoniam tamen minoribus annorum desiderantibus curatores dari solent, si curator patronus petatur, fides inquisitionis pro uinculo cedet cautionis.
But if a girl has completed her twelfth year, the tutor ceases to exist; however, since curators are accustomed to be appointed for minors who request them, if the patron is requested as curator, the trust of an investigation shall take the place of the bond of security.
