[THE SAME, Book 28 of Questions.] After the dowry had been given and the marriage contracted, the father stipulated that the dowry should be given [to him] if a divorce was made not according to the daughter's will.
si condicio stipulationis impleatur et postea filia sine liberis decesserit, non erit impediendus pater, quo minus ex stipulatu agat: uiua autem filia si agere uult, exceptione summouendus erit.
If the condition of the stipulation is fulfilled and afterwards the daughter dies without children, the father must not be prevented from bringing an action based on the stipulation; but if he wishes to sue while the daughter is alive, he must be barred by an exception.
