[THE SAME, in the third book on Sabinus.] Someone made a donation mortis causa of a slave to his wife and designated him in his will as heir with freedom: it is asked whether the institution is valid.
et puto, si hoc animo eum scripsit heredem, quod donationis se dixit paenituisse, ualere institutionem et necessarium heredem domino seruum fieri: ceterum si, posteaquam heredem instituit, donauit, donatio praeualebit, uel si ante donauit, non tamen adimendi animo libertatem adscripsit.
And I think that if he designated him as heir with this intention, namely, because he said he regretted the donation, the institution is valid and the slave becomes a necessary heir to his master: but if he made the donation after he instituted him as heir, the donation will prevail; or if he made the donation beforehand, yet wrote down the freedom not with the intention of revoking [the donation].
