[ULPIANUS, Book XXV on the Edict.] If pledges are sold by the attendants of the praetor in execution of judgments outside the ordinary course, no one has ever said that an action should be granted against them if the property is evicted; but if through malice they have thrown away the property at a lower price, then an action on the ground of malice is granted against them to the owner of the property.
