[PAULUS, in his third book of Questions.] If a father accepted from an heir the heir's own property in pledge for a conditional legacy left to his son-in-power, and, upon the death of the father or the emancipation of the son, the condition of the legacy is fulfilled, the legacy begins to be owed to the son, and neither can the father claim the pledge, nor can the son; for although the son has now begun to have an action, he cannot have any right in the pledge from the preceding time, just as is said in the case of a guarantor.
