§19.1.2.1Uacua possessio emptori tradita non intellegitur, si alius in ea legatorum fideiue commissorum seruandorum causa in possessione est aut creditores bona possideant.
Vacant possession is not understood to have been delivered to the buyer, if another person is in possession of the property for the purpose of preserving legacies or trusts, or if creditors possess the goods.
idem dicendum est, si uenter in possessione sit: nam et ad hoc pertinet uacui appellatio.
The same must be said if an unborn child is in possession; for the designation "vacant" applies to this case as well.
