[PAPINIANUS, Questions, Book X] It matters little for extinguishing the condictio whether the stolen slave is offered, or is transferred to another title and another state of obligation; nor does it concern me whether the slave was present or not, since the default, which arose from the theft, is ended, as it were, by a kind of delegation.
