[SCAEVOLA, Questions, book 2] If anyone owned several estates and bequeathed the usufruct of all of them separately, the body can be buried in one of them, and the choice will belong to the heir, and there is room for favor; but an equitable action must be granted to the usufructuary against the heir to recover that by which the usufruct was diminished on account of that choice.

If the heir of a woman buries the deceased woman in an inherited estate, he shall recover from the husband, who ought to contribute to the funeral, in proportion to the valuation of the burial place.

It was held that, to the person to whom garments are bequeathed, if they have been spent on the funeral, an equitable action against the heir and the funeral privilege must be granted.
