[PAULUS, Sentences, book 5.] But if those goods, in respect of which the emperor has been instituted as heir, are insolvent, the emperor is consulted after the circumstances have been examined; for the will of the instituted heir must be ascertained in accepting or repudiating inheritances of this kind.
