§12ὅτι μὲν οὖν οὔτε πρόνοια ἐγένετο οὔτε ἀδικῶ τοῦτον, ὦ βουλή, ἐκ τοσούτων τεκμηρίων καὶ μαρτυριῶν ὑμῖν ἐπιδέδεικται·
Therefore, O Council, it has been demonstrated to you by so many proofs and testimonies that there was neither premeditation nor that I am doing this man wrong.
ἀξιῶ δʼ ὅσον ἂν ἐγένετο σημεῖον τούτῳ πρὸς τὸ δοκεῖν ἀληθῆ λέγειν φυγόντος ἐμοῦ τὴν βάσανον, τοσοῦτον ἐμοὶ τεκμήριον γενέσθαι ὅτι οὐ ψεύδομαι, διότι οὗτος οὐκ ἠθέλησεν ἐκ τῆς ἀνθρώπου ποιήσασθαι τὸν ἔλεγχον, καὶ μὴ τοσοῦτον ἰσχῦσαι τοὺς τούτου λόγους, ὅτι φησὶν αὐτὴν ἐλευθέραν εἶναι.
And I demand that, just as it would have been a proof for him to seem to speak the truth if I had fled from the torture, so much of a proof should it be for me that I am not lying, because he did not wish to make the test from the woman, and that his words should not have so much force because he says she is free.
ὁμοίως γὰρ προσήκει κἀμοὶ τῆς ἐλευθερίας, τὸ ἴσον καταθέντι ἀργύριον.
For it is equally appropriate for me to have a share in her freedom, having contributed an equal amount of money.
§13ἀλλὰ ψεύδεται καὶ οὐκ ἀληθῆ λέγει.
But he is lying and not speaking the truth.
ἢ δεινόν γε, εἰ εἰς μὲν λύσιν τοῦ σώματος ἐκ τῶν πολεμίων ἐξῆν ἄν μοι χρῆσθαι αὐτῇ ὅ τι ἐβουλόμην, κινδυνεύοντι δέ μοι περὶ τῆς πατρίδος οὐδὲ πυθέσθαι παρʼ αὐτῆς τἀληθῆ ἐκγενήσεται περὶ ὧν εἰς τὴν κρίσιν καθέστηκα·
Or indeed, it would be terrible if, while it was open to me to use her as I pleased for the ransom of my body from enemies, yet when I am in danger concerning my homeland, it will not even be possible for me to learn the truth from her regarding the matters for which I have been brought to trial.
καὶ μὲν δὴ πολὺ ἂν δικαιότερον ἐπὶ ταύτῃ τῇ αἰτίᾳ βασανισθείη ἢ ἐπὶ τῇ ἐκ τῶν πολεμίων λύσει πραθείη, ὅσῳ παρὰ μὲν ἐκείνων βουλομένων ἀπολῦσαι ἔστι καὶ ἄλλοθεν εὐπορήσαντι κομισθῆναι, ἐπὶ δὲ τοῖς ἐχθροῖς γενόμενον οὐ δυνατόν· οὐ γὰρ ἀργύριον λαβεῖν προθυμοῦνται, ἀλλʼ ἐκ τῆς πατρίδος ἐκβαλεῖν ἔργον ποιοῦνται.
Indeed, she would much more justly be tortured on this charge than be sold for ransom from enemies, inasfar as from the latter, if they wish to release, it is possible to be recovered by finding means from elsewhere, but when fallen into the hands of one's enemies, it is not possible; for they do not desire to receive money, but make it their business to expel one from the homeland.
§14ὥσθʼ ὑμῖν προσήκει μὴ ἀποδέχεσθαι αὐτοῦ διὰ τοῦτο οὐκ ἀξιοῦντος βασανισθῆναι τὴν ἄνθρωπον, ὅτι αὐτὴν ἐλευθέραν ἐσκήπτετο εἶναι, ἀλλὰ πολὺ μᾶλλον συκοφαντίαν καταγιγνώσκειν, ὅτι παραλιπὼν ἔλεγχον οὕτως ἀκριβῆ ἐξαπατήσειν ὑμᾶς ῥᾳδίως ᾠήθη.
Therefore, it is appropriate for you not to accept his plea that the woman should not be tortured on this account, namely that he pretended she was free, but much more to condemn him for malicious prosecution, because, having bypassed so precise a test, he thought he would easily deceive you.
§15οὐ γὰρ δήπου τήν γε τούτου πρόκλησιν πιστοτέραν ὑμᾶς νομίζειν δεῖ τῆς ἡμετέρας, ἐφʼ οἷς αὑτοῦ οἰκέτας ἠξίου βασανίζεσθαι.
For surely you must not think his challenge more trustworthy than ours, on the grounds that he demanded his own slaves be tortured.
ἃ μὲν γὰρ ἐκεῖνοι ᾔδεσαν, ἐλθόντας ἡμᾶς ὡς τοῦτον, καὶ ἡμεῖς ὁμολογοῦμεν.
For what those slaves knew—that we went to his place—we also admit.
εἰ δὲ μεταπεμφθέντες ἢ μή, καὶ πότερον πρότερος ἐπλήγην ἢ ἐπάταξα, §16ἐκείνη μᾶλλον ἂν ᾔδει.
But whether we were sent for or not, and whether I was struck first or I hit him, she would have known better.
ἔτι δὲ τοὺς μὲν τούτου οἰκέτας ἰδίους ὄντας τούτου εἰ ἐβασανίζομεν, ἀνοήτως ἄν τι τούτῳ χαριζόμενοι καὶ παρὰ τὴν ἀλήθειαν ἐμοῦ κατεψεύσαντο· αὕτη δὲ ὑπῆρχε κοινή, ὁμοίως ἀμφοτέρων ἀργύριον κατατεθηκότων, καὶ μάλιστα ᾔδει· διὰ ταύτην ἅπαντα τὰ πραχθέντα ἡμῖν γεγένηται·
Furthermore, if we tortured his slaves, who were his private property, they might have foolishly lied against me contrary to the truth to curry favor with him; but she was common property, both having contributed money equally, and she knew best of all; it was on her account that all that has been done by us took place.
§17καὶ οὐ λήσει οὐδένʼ ὅτι ταύτης ἔγωγʼ ἄνισον εἶχον βασανισθείσης, ἀλλʼ ἀπεκινδύνευον τοῦτο· πολὺ γὰρ περὶ πλείονος τοῦτον ἢ ἐμὲ φαίνεται ποιησαμένη, καὶ μετὰ μὲν τούτου ἐμὲ ἠδικηκυῖα, μετʼ ἐμοῦ δʼ οὐδεπώποτε εἰς τοῦτον ἐξαμαρτοῦσα.
And it will not escape anyone's notice that I had an unequal risk if she were tortured, but I was willing to run this hazard; for she is manifest to have valued him much more than me, and while she joined with him in doing me wrong, she never joined with me in committing any offense against him.
ἀλλʼ ὅμως ἐγὼ μὲν εἰς ταύτην κατέφυγον, οὗτος δὲ οὐκ ἐπίστευσεν αὐτῇ.
But nevertheless, I fled to her, while he did not trust her.
§18οὔκουν δεῖ ὑμᾶς, ὦ βουλή, τηλικούτου ὄντος τοῦ κινδύνου, ῥᾳδίως ἀποδέχεσθαι τοὺς τούτου λόγους, ἀλλʼ ἐνθυμουμένους ὅτι περὶ τῆς πατρίδος μοι καὶ τοῦ βίου ὁ ἀγών ἐστιν, ἐν ὑπολόγῳ ταύτας τὰς προκλήσεις ποιεῖσθαι.
Therefore, O Council, since the danger is so great, you must not easily accept his words, but, reflecting that the struggle for me is about my homeland and my life, you should take these challenges into account.
καὶ μὴ ζητεῖτε τούτων ἔτι μείζους πίστεις· οὐ γὰρ ἂν ἔχοιμι εἰπεῖν ἀλλʼ ἢ ταύτας, ὡς οὐδὲν εἰς τοῦτον προὐνοήθην.
And do not seek even greater proofs than these; for I would have none to state other than these, to show that I did not premeditate anything against him.
§19ἀγανακτῶ δʼ, ὦ βουλή, εἰ διὰ πόρνην καὶ δούλην ἄνθρωπον περὶ τῶν μεγίστων εἰς κίνδυνον καθέστηκα, τί κακὸν πώποτε τὴν πόλιν ἢ αὐτὸν τοῦτον εἰργασμένος, ἢ εἰς τίνα τῶν πολιτῶν ὁτιοῦν ἐξαμαρτών;
And I am indignant, O Council, if for the sake of a courtesan and slave woman I have been placed in danger regarding the most important matters, when I have never done any harm to the city or to this man himself, nor committed any offense against any of the citizens.
οὐδὲν γὰρ ἔμοιγέ ἐστι τοιοῦτον πεπραγμένον, ἀλλʼ ἀλογώτατον πάντων κινδυνεύω πολὺ μείζω συμφορὰν ἐμαυτῷ διὰ τούτους ἐπαγαγέσθαι.
For no such thing has been done by me, but most unreasonably of all, I am in danger of bringing a much greater misfortune upon myself because of these men.
§20πρὸς οὖν παίδων καὶ γυναικῶν καὶ θεῶν τῶν τόδε τὸ χωρίον ἐχόντων ἱκετεύω ὑμᾶς καὶ ἀντιβολῶ, ἐλεήσατέ με, καὶ μὴ περιίδητε ἐπὶ τούτῷ γενόμενον, μηδὲ ἀνηκέστῳ συμφορᾷ περιβάλητε· οὐ γὰρ ἄξιος οὔτʼ ἐγὼ φεύγειν τὴν ἐμαυτοῦ, οὔτε οὗτος τοσαύτην δίκην παρʼ ἐμοῦ λαβεῖν ὑπὲρ ὧν φησιν ἠδικῆσθαι, οὐκ ἠδικημένος.
Therefore, by your children and wives and the gods who possess this place, I supplicate and entreat you: have mercy on me, and do not overlook my falling into this man's power, nor envelop me in an irremediable misfortune; for neither am I deserving of exile from my own country, nor is he deserving of obtaining so great a punishment from me for what he claims to have been wronged, when he was not wronged.
