§1.28.7ἔστι δὲ καὶ ἐντὸς τοῦ περιβόλου μνῆμα Οἰδίποδος, πολυπραγμονῶν δὲ εὕρισκον τὰ ὀστᾶ ἐκ Θηβῶν κομισθέντα· τὰ γὰρ ἐς τὸν θάνατον Σοφοκλεῖ πεποιημένα τὸν Οἰδίποδος Ὅμηρος οὐκ εἴα μοι δόξαι πιστά, ὃς ἔφη Μηκιστέα τελευτήσαντος Οἰδίποδος ἐπιτάφιον ἐλθόντα ἐς Θήβας ἀγωνίσασθαι.
And there is also within the enclosure a tomb of Oedipus, and on inquiring inquisitively I found that his bones were brought from Thebes; for Homer did not allow me to believe the story composed by Sophocles concerning the death of Oedipus, since Homer said that when Oedipus had died, Mecisteus came to Thebes for his funeral games and competed.
§1.28.8ἔστι δὲ Ἀθηναίοις καὶ ἄλλα δικαστήρια οὐκ ἐς τοσοῦτο δόξης ἥκοντα.
And there are also other courts for the Athenians that have not reached such great fame.
τὸ μὲν οὖν καλούμενον παράβυστον καὶ τρίγωνον, τὸ μὲν ἐν ἀφανεῖ τῆς πόλεως ὂν καὶ ἐπʼ ἐλαχίστοις συνιόντων ἐς αὐτό, τὸ δὲ ἀπὸ τοῦ σχήματος ἔχει τὰ ὀνόματα· βατραχιοῦν δὲ καὶ φοινικιοῦν ἀπὸ χρωμάτων καὶ ἐς τόδε διαμεμένηκεν ὀνομάζεσθαι.
The one called Parabyston and the Trigonon—the former being in an obscure part of the city and people meeting in it for the smallest matters, and the latter having its name from its shape—and Batrachioun and Phoinikioun have remained named after their colors even to this day.
τὸ δὲ μέγιστον καὶ ἐς ὃ πλεῖστοι συνίασιν, ἡλιαίαν καλοῦσιν.
And the largest one, into which the greatest number meet, they call Heliaia.
ὁπόσα δὲ ἐπὶ τοῖς φονεῦσιν, ἔστιν ἄλλα· καὶ ἐπὶ Παλλαδίῳ καλοῦσι καὶ τοῖς ἀποκτείνασιν ἀκουσίως κρίσις καθέστηκε.
And those for murderers are others; and at the place called Palladium, a trial is established for those who have killed involuntarily.
καὶ ὅτι μὲν Δημοφῶν πρῶτος ἐνταῦθα ὑπέσχε δίκας, ἀμφισβητοῦσιν οὐδένες· §1.28.9ἐφʼ ὅτῳ δέ, διάφορα ἐς τοῦτο εἴρηται.
And that Demophon was the first to undergo trial there, no one disputes; but as to for what reason, different accounts are given of this.
Διομήδην φασὶν ἁλούσης Ἰλίου ταῖς ναυσὶν ὀπίσω κομίζεσθαι, καὶ ἤδη τε νύκτα ἐπέχειν ὡς κατὰ Φάληρον πλέοντες γίνονται καὶ τοὺς Ἀργείους ὡς ἐς πολεμίαν ἀποβῆναι τὴν γῆν, ἄλλην που δόξαντας ἐν τῇ νυκτὶ καὶ οὐ τὴν Ἀττικὴν εἶναι.
They say that Diomedes, after the capture of Ilium, was returning home with his ships, and it was already night when they came in sailing near Phalerum, and the Argives landed on the territory as if it were a hostile land, thinking in the night that it was some other country and not Attica.
ἐνταῦθα Δημοφῶντα λέγουσιν ἐκβοηθήσαντα, οὐκ ἐπιστάμενον οὐδὲ τοῦτον τοὺς ἀπὸ τῶν νεῶν ὡς εἰσὶν Ἀργεῖοι, καὶ ἄνδρας αὐτῶν ἀποκτεῖναι καὶ τὸ Παλλάδιον ἁρπάσαντα οἴχεσθαι, Ἀθηναῖόν τε ἄνδρα οὐ προϊδόμενον ὑπὸ τοῦ ἵππου τοῦ Δημοφῶντος ἀνατραπῆναι καὶ συμπατηθέντα ἀποθανεῖν·
There they say that Demophon came out to help, he too not knowing that those from the ships were Argives, and killed some of them, and having seized the Palladium went away; and an Athenian citizen, who did not see him beforehand, was knocked down by Demophon's horse and died from being trampled.
ἐπὶ τούτῳ Δημοφῶντα ὑποσχεῖν δίκας οἱ μὲν τοῦ συμπατηθέντος τοῖς προσήκουσιν, οἱ δὲ Ἀργείων φασὶ τῷ κοινῷ.
On this account, some say Demophon underwent trial before the relatives of the man who was trampled, and others before the Argive community.
§1.28.10ἐπὶ Δελφινίῳ δὲ κρίσις καθέστηκεν ἐργάσασθαι φόνον σὺν τῷ δικαίῳ φαμένοις, ὁποῖόν τι καὶ Θησεὺς παρεχόμενος ἀπέφυγεν, ὅτε Πάλλαντα ἐπαναστάντα καὶ τοὺς παῖδας ἔκτεινε· πρότερον δὲ πρὶν ἢ Θησεὺς ἀφείθη, καθειστήκει πᾶσι φεύγειν κτείναντα ἢ κατὰ ταὐτὰ θνήσκειν μένοντα.
And at the Delphinium, a trial is established for those who claim to have committed murder with justice, such as Theseus also offered and was acquitted when he killed Pallas, who had risen in rebellion, and his sons; but before Theseus was acquitted, it was established for everyone who killed to flee or, if they remained, to die in the same manner.
τὸ δὲ ἐν πρυτανείῳ καλούμενον, ἔνθα τῷ σιδήρῳ καὶ πᾶσιν ὁμοίως τοῖς ἀψύχοις δικάζουσιν, ἐπὶ τῷδε ἄρξασθαι νομίζω.
And the court called "in the Prytaneum", where they try iron and all alike inanimate objects, I believe started from this.
Ἀθηναίων βασιλεύοντος Ἐρεχθέως, τότε πρῶτον βοῦν ἔκτεινεν ὁ βουφόνος ἐπὶ τοῦ βωμοῦ τοῦ Πολιέως Διός· καὶ ὁ μὲν ἀπολιπὼν ταύτῃ τὸν πέλεκυν ἀπῆλθεν ἐκ τῆς χώρας φεύγων, ὁ δὲ πέλεκυς παραυτίκα ἀφείθη κριθεὶς καὶ ἐς τόδε ἀνὰ πᾶν ἔτος κρίνεται.
When Erechtheus was king of the Athenians, then for the first time the ox-slayer killed an ox on the altar of Zeus Polieus; and he, leaving the axe there, fled and went out of the country, but the axe was immediately acquitted after being tried, and is tried every year to this day.
§1.28.11λέγεται μὲν δὴ καὶ ἄλλα τῶν ἀψύχων αὐτόματα ἐπιθεῖναι σὺν τῷ δικαίῳ τιμωρίαν ἀνθρώποις· ἔργον δὲ κάλλιστον καὶ δόξῃ φανερώτατον ὁ Καμβύσου παρέσχετο ἀκινάκης.
Indeed, other inanimate things also are said to have inflicted just punishment upon men of their own accord; and the sword of Cambyses offered the finest and most famous deed in reputation.
ἔστι δὲ τοῦ Πειραιῶς πρὸς θαλάσσῃ Φρεαττύς· ἐνταῦθα οἱ πεφευγότες, ἢν ἀπελθόντας ἕτερον ἐπιλάβῃ σφᾶς ἔγκλημα, πρὸς ἀκροωμένους ἐκ τῆς γῆς ἀπὸ νεὼς ἀπολογοῦνται· Τεῦκρον πρῶτον λόγος ἔχει Τελαμῶνι οὕτως ἀπολογήσασθαι μηδὲν ἐς τὸν Αἴαντος θάνατον εἰργάσθαι.
And there is Phreattys in the Piraeus near the sea; there those who are in exile, if another charge overtakes them after their departure, make their defense from a ship to those who listen from the land; the story goes that Teucer was the first to defend himself thus to Telamon, that he had done nothing to cause the death of Ajax.
τάδε μὲν οὖν εἰρήσθω μοι τῶνδε ἕνεκα, γνῶναι ὁπόσοις μέτεστι σπουδῆς τὰ ἐς τὰ δικαστήρια·
Let these things, then, be said by me for these reasons, so that men may know how much diligence is shown concerning the courts.
