Aristotle · Politics §6.1322a

Offices of Execution and Custody and Military Magistracies

Passage 118 of 155 · Greek

Summary

The text discusses the difficulty and necessity of the office of execution and custody, suggesting institutional divisions and rotations to minimize unpopularity, and then introduces high-status offices related to city defense and military needs.

Therefore, it is indeed difficult because of having much unpopularity, so that where there is no great gain to be made, they neither submit to hold it, nor, having submitted, are they willing to execute it according to the laws; but it is necessary, because there is no use in lawsuits about rights taking place, if these do not reach their end, so that if, when these do not take place, it is impossible to associate with one another, it is also impossible when executions do not take place.
Therefore, it is better that this office not be one, but different persons from different courts, and concerning the postings of those registered, to try to divide them in the same way; and further, that other offices too should execute some penalties, and particularly that the new offices execute those of the old ones, and regarding current judgments, when one office has condemned, another is to be the executing one, for instance, that the town-wardens execute those from the market-wardens, and others execute those from these.
For by how much less unpopularity is inherent in those executing them, by so much more will the executions reach their end; on the one hand, that the same persons are those who condemn and those who execute has double unpopularity, and on the other hand, that the same persons execute in all cases makes them enemies to everyone.
And indeed in many places the office that guards is also divided from the executing one, as at Athens that of the so-called Eleven.
Therefore, it is better to separate this one too, and to seek an ingenious device concerning this one as well.
For it is no less necessary than the one mentioned, but it happens that respectable men especially avoid this office, while it is not safe to make base men sovereign over it; for they themselves stand in need of guarding by others rather than being able to guard others.
Therefore, there must not be one single office assigned to them, nor continuously the same one, but of the young men, where there is some troop of ephebes or guards, and of the offices, different ones in turn must undertake the supervision.
These offices, then, must be posited as first because they are the most necessary, and after these, those that are no less necessary, but ranked in greater dignity; for they require much experience and trust.
Such would be those concerning the guarding of the city, and those appointed for military needs.
And there must be, both in peace and in war, superintendents likewise of the guarding of gates and walls, and of the muster and organization of the citizens.
In some places, then, there are several offices for all these matters, and in others fewer, for instance in small cities one over all of them.
And they call such officers generals and polemarchs.

Notes

  1. 1322aὥστʼ εἰ μὴ γιγνομένων κοινωνεῖν ἀδύνατον ἀλλήλοις, καὶ πράξεων μὴ γιγνομένων — "εἰ μὴ γιγνομένων" is a genitive absolute clause with the omitted subject δίκαι (lawsuits) from the previous sentence, meaning "if lawsuits do not take place". "καὶ πράξεων μὴ γιγνομένων" is also a genitive absolute clause ("and if executions do not take place"), forming a comparative structure where the main clause "κοινωνεῖν ἀδύνατον ἀλλήλοις" (it is impossible to associate with one another) is omitted in the second part.
  2. 1322aτῶν ἔνων μᾶλλον τὰς νέας — Contrast between τῶν ἔνων, the genitive plural neuter/feminine of the adjective ἕνος (old), used substantively, and τὰς νέας, the accusative plural feminine of νέος (new). The ellipsis should be supplied so that the "new" offices execute the penalties or judgments of the "old" ones.
  3. 1322aτὸ μὲν οὖν τοὺς αὐτοὺς εἶναι τοὺς καταδικάσαντας καὶ πραττομένους — The articular infinitive clause led by the article τὸ (τὸ τοὺς αὐτοὺς εἶναι...) serves as the subject. The accusative τοὺς αὐτούς is the subject accusative (or complement) of the infinitive εἶναι, with which the participles τοὺς καταδικάσαντας καὶ πραττομένους (those who condemn and those who execute) are placed in apposition.
