§7.38.1διαλυθείσης δὲ τῆς στρατιᾶς ὁ μὲν Σικίννιος ὁ δήμαρχος συναγαγὼν τὸ πλῆθος εἰς ἐκκλησίαν προεῖπεν ἡμέραν, ἐν ᾗ συντελεῖν ἔμελλε τὴν περὶ τοῦ Μαρκίου κρίσιν· καὶ παρεκάλει τούς τε κατὰ πόλιν ὑπάρχοντας ἀθρόους ἥκειν ἐπὶ τὴν διάγνωσιν τῆς δίκης καὶ τοὺς ἐπὶ τῶν ἀγρῶν διατρίβοντας ἀφεμένους τῶν ἔργων εἰς τὴν αὐτὴν ἡμέραν ἀπαντᾶν, ὡς ὑπὲρ ἐλευθερίας καὶ σωτηρίας ὅλης τῆς πόλεως τὴν ψῆφον ἀναληψομένους·
When the army was disbanded, the tribune Sicinius, having assembled the multitude in an assembly, appointed the day on which he was to conduct the trial of Marcius; and he exhorted those who were in the city to come in a body to the decision of the suit, and those who spent their time in the country to leave their work and meet on the same day, as they were about to cast their votes for the liberty and safety of the whole city.
παρήγγελλε δὲ καὶ τῷ Μαρκίῳ παρεῖναι πρὸς τὴν ἀπολογίαν ὡς οὐδενὸς ἀτυχήσοντι τῶν περὶ §7.38.2τὰς κρίσεις νομίμων.
He also ordered Marcius to be present for his defense, assuring him that he would not fail of any of the legal rights concerning trials.
τοῖς δʼ ὑπάτοις ἐδόκει βουλευσαμένοις μετὰ τοῦ συνεδρίου μὴ περιορᾶν τὸν δῆμον ἐξουσίας τηλικαύτης κύριον γενόμενον.
But the consuls, having consulted with the senate, resolved not to allow the people to become masters of so great a power.
εὕρητο δʼ αὐτοῖς τῆς κωλύσεως ἀφορμὴ δικαία καὶ νόμιμος, ᾗ χρώμενοι πάντα διαλύσειν ᾤοντο τὰ τῶν ἀντιδίκων βουλεύματα.
They had found a just and legal pretext for preventing this, by using which they thought they would dissolve all the designs of their adversaries.
καὶ μετὰ τοῦτο παρεκάλεσαν εἰς λόγους ἐλθεῖν τοὺς προεστηκότας τοῦ δήμου συνόντων αὐτοῖς τῶν ἐπιτηδείων.
And after this, they requested the leaders of the people to come to a conference, together with their own friends.
§7.38.3καὶ ἔλεξε Μηνύκιος τοιάδε· ἡμῖν, ὦ δήμαρχοι, δοκεῖ χρῆναι τὴν στάσιν ἐξελαύνειν ἐκ τῆς πόλεως ἁπάσῃ δυνάμει καὶ μὴ φιλονεικεῖν ἐναντία τῷ δήμῳ περὶ μηδενὸς χρήματος· μάλιστα δʼ ὅταν ὁρῶμεν ὑμᾶς ἀπὸ τῶν βιαίων ἐπὶ τὰ δίκαια καὶ τοὺς λόγους ἥκοντας.
And Minucius spoke as follows: "We believe, tribunes, that we ought to expel discord from the city with all our might, and not to contend in opposition to the people on any matter; especially when we see you turning from violent measures to justice and reason.
ταύτης μέντοιγε τῆς γνώμης ἐπαινοῦντες ὑμᾶς τὴν βουλὴν οἰόμεθα δεῖν ἄρξαι προβούλευμα ποιησαμένην, ὥσπερ ἐστὶν ἡμῖν πάτριον.
However, while we commend you for this mind, we think that the senate ought to take the lead by making a preliminary decree, as is our ancestral custom.
δύναισθε δʼ ἂν καὶ §7.38.4αὐτοὶ τοῦτο μαρτυρεῖν, ὅτι, ἐξ οὗ τήνδε τὴν πόλιν ἔκτισαν ἡμῶν οἱ πρόγονοι, τοῦτο τὸ γέρας ἔχουσα ἡ βουλὴ διατετέλεκε, καὶ οὐθὲν πώποτε ὁ δῆμος, ὅ τι μὴ προβουλεύσειεν ἡ βουλή, οὔτʼ ἐπέκρινεν οὔτʼ ἐπεψήφισεν, οὐχ ὅτι νῦν, ἀλλʼ οὐδʼ ἐπὶ τῶν βασιλέων, ἀλλʼ ὅσα τῷ συνεδρίῳ δόξειε, ταῦθʼ οἱ βασιλεῖς εἰς τὸν δῆμον ἐκφέροντες ἐπεκύρουν.
You yourselves would be able to testify to this: that ever since our ancestors founded this city, the senate has continued to hold this privilege, and the people have never, either now or even in the times of the kings, decided or voted on anything that the senate had not first decreed; rather, whatever seemed good to the senate, the kings brought before the people and ratified.
μὴ δὴ τοῦτʼ ἀφαιρεῖσθε τὸ δίκαιον ἡμῶν, μηδὲ ἀρχαῖον καλὸν ἔθος ἀφανίζετε· διδάξαντες δὲ τὸ συνέδριον, ὅτι δικαίου δεῖσθε καὶ μετρίου πράγματος, ὅτι ἂν ἐκείνῳ δοκῇ, τούτου τὸν δῆμον ἀποδείξατε κύριον.
Do not, then, deprive us of this right, nor abolish an ancient and excellent custom; but having shown the senate that you demand what is just and moderate, whatever seems good to that body, make the people masters of it."
