§10.8.1ταῦτʼ εἰπόντος αὐτοῦ κραυγή τε ἐκ τῶν παρόντων ἐγένετο καὶ ὁρμὴ πολλῶν ἐπὶ τὴν ἐκ χειρὸς δίκην.
When he had said this, a shout arose from those present, and many rushed to take justice into their own hands.
ἀλλʼ οἵ τε ὕπατοι ἐμποδὼν ἐγένοντο καὶ τῶν δημάρχων οἱ πλείους πονηρὸν ἔθος οὐκ ἀξιοῦντες εἰς τὴν πόλιν εἰσάγειν.
But the consuls stood in their way, as did the majority of the tribunes, who did not think it right to introduce a wicked custom into the city.
ἦν δὲ καὶ τοῦ δήμου τὸ καθαρώτατον οὐ βουλόμενον ἀποστερεῖν λόγου τοὺς ὑπὲρ τῶν μεγίστων ἀγωνιζομένους.
And even the most decent part of the plebeians did not wish to deprive those who were contending for the greatest stakes of a hearing.
§10.8.2τότε μὲν οὖν ἐπέσχε τὴν τῶν θρασυτέρων ὁρμὴν ἡ τοῦ δικαίου πρόνοια, καὶ ἀναβολὴν ἔλαβεν ἡ δίκη, οὐ μικρᾶς ἐμπεσούσης φιλοτιμίας καὶ ζητήσεως ὑπὲρ τοῦ σώματος, εἴτʼ ἐν δεσμοῖς αὐτὸ δεῖ φυλάττεσθαι τέως, εἴτʼ ἐγγυητὰς δοῦναι τῆς ἀφίξεως, ὥσπερ καὶ ὁ πατὴρ ἠξίου· καὶ ἡ βουλὴ συνελθοῦσα ἐψηφίσατο χρήμασι διεγγυηθὲν ἐλεύθερον εἶναι τὸ σῶμα μέχρι δίκης.
At that time, therefore, the regard for justice restrained the impulse of the more reckless, and the trial was postponed, after no small rivalry and inquiry arose concerning his person, whether he should be kept in bonds in the meantime, or should give guarantors for his appearance, just as his father requested; and the senate, having assembled, voted that his person should be free until the trial, upon being bailed with money.
§10.8.3τῇ δʼ ἑξῆς ἡμέρᾳ συναγαγόντες οἱ δήμαρχοι τὸ πλῆθος, ἐκλιπόντος τοῦ μειρακίου τὴν δίκην, ἐκύρωσαν τὴν κατʼ αὐτοῦ ψῆφον καὶ τοὺς ἐγγυητὰς δέκα ὄντας ἐπράξαντο τὰ περὶ τοῦ σώματος τῆς ἀποκαταστάσεως ὁμολογηθέντα χρήματα.
On the following day, the tribunes having assembled the multitude, since the youth had failed to appear at the trial, they confirmed the vote against him and exacted from the guarantors, who were ten in number, the money agreed upon for the restoration of his person.
§10.8.4Καίσων μὲν οὖν τοιαύτῃ περιπεσὼν ἐπιβουλῇ, κατασκευασαμένων ἅπαντα τῶν δημάρχων καὶ Οὐολουσκίου ψευδῆ μαρτυρήσαντος, ὡς ἐγένετο φανερὸν σὺν χρόνῳ, φεύγων εἰς Τυρρηνίαν ᾤχετο·
Caeso, therefore, having fallen into such a conspiracy, with the tribunes having fabricated everything and Volscius having given false testimony—as became clear in the course of time—went into exile to Etruria.
ὁ δὲ πατὴρ αὐτοῦ τὰ πλεῖστα τῆς οὐσίας ἀπεμπολήσας καὶ τὰ ὁμολογηθέντα ὑπὸ τῶν ἐγγυητῶν χρήματα ἀποδοὺς ἑαυτῷ χωρίον ἓν μικρὸν ὑπολειπόμενος πέραν τοῦ Τεβέριος ποταμοῦ, ἐν ᾧ ταπεινή τις ἦν καλύβη, γεωργῶν αὐτόθι μετὰ δούλων ὀλίγων ἐπίπονον καὶ ταλαίπωρον ἔζη βίον ὑπὸ λύπης τε καὶ πενίας, οὔτε πόλιν ὁρῶν οὔτε φίλους ἀσπαζόμενος οὔθʼ ἑορτάζων οὔτʼ ἄλλης εὐφροσύνης οὐδεμιᾶς ἑαυτῷ μεταδιδούς.
And his father, having sold the greater part of his estate and paid the money agreed upon by the guarantors, reserved for himself one small piece of land across the Tiber River, where there was a humble cottage; and farming there with a few slaves, he lived a laborious and wretched life under the weight of grief and poverty, neither seeing the city, nor greeting friends, nor keeping festivals, nor sharing in any other joy.
τοῖς μέντοι δημάρχοις πολὺ τὸ παράλογον ἐγένετο τῆς ἐλπίδος.
However, for the tribunes, their expectation turned out to be far contrary to what they hoped.
οὐ γὰρ ὅπως ἐπαύσατο ἡ τῶν νέων φιλοτιμία σωφρονισθεῖσα τῇ Καίσωνος συμφορᾷ, πολὺ δὲ χαλεπωτέρα καὶ πλείων ἐγένετο ἔργοις τε καὶ λόγοις καταγωνιζομένη τὸν νόμον· ὥστʼ οὐθὲν ἔτι αὐτοῖς ἐξεγένετο διαπράξασθαι δαπανηθέντος εἰς ταῦτα τοῦ χρόνου τῆς ἀρχῆς.
For far from the rivalry of the youth being stopped, chastened by the misfortune of Caeso, it became much more severe and greater, fighting against the law in both deeds and words; so that it was no longer possible for them to achieve anything, the time of their office being consumed in these matters.
ὁ μέντοι δῆμος εἰς τὸν ἐπιόντα πάλιν ἐνιαυτὸν ἄρχοντας ἀπέδειξεν αὐτούς.
Nevertheless, the plebeians appointed them magistrates again for the following year.
