§6.764ΑΘ. χειροτονείτω δὲ πᾶς πάντα· ὁ δὲ μὴ ʼθέλων, ἐὰν εἰσαγγελθῇ πρὸς τοὺς ἄρχοντας, ζημιούσθω πεντήκοντα δραχμαῖς πρὸς τῷ κακὸς εἶναι δοκεῖν.
ATH.: And let everyone vote for all offices; and let the one who is unwilling, if he is reported to the officials, be fined fifty drachmas, in addition to being thought to be bad.
ἴτω δʼ εἰς ἐκκλησίαν καὶ τὸν κοινὸν σύλλογον ὁ βουλόμενος, ἐπάναγκες δʼ ἔστω τῷ τῶν δευτέρων καὶ πρώτων τιμημάτων, δέκα δραχμαῖς ζημιουμένῳ ἐὰν μὴ παρὼν ἐξετάζηται τοῖς συλλόγοις· τρίτῳ δὲ τιμήματι καὶ τῷ τετάρτῳ μὴ ἐπάναγκες, ἀλλὰ ἀζήμιος ἀφείσθω, ἐὰν μή τι παραγγείλωσιν οἱ ἄρχοντες πᾶσιν ἔκ τινος ἀνάγκης συνιέναι.
And let whoever wishes go to the assembly and the common gathering, but let it be compulsory for the one of the second and first property classes, being fined ten drachmas if he is not found present at the gatherings; but for the third and fourth property class, let it not be compulsory, but let him be dismissed without fine, unless the officials issue a command for all to assemble from some necessity.
τοὺς δὲ δὴ ἀγορανόμους τὸν περὶ τὴν ἀγορὰν κόσμον διαταχθέντα ὑπὸ νόμων φυλάττειν, καὶ ἱερῶν καὶ κρηνῶν ἐπιμελεῖσθαι τῶν κατʼ ἀγοράν, ὅπως μηδὲν ἀδικῇ μηδείς, τὸν ἀδικοῦντα δὲ κολάζειν, πληγαῖς μὲν καὶ δεσμοῖς δοῦλον καὶ ξένον, ἐὰν δʼ ἐπιχώριος ὤν τις περὶ τὰ τοιαῦτα ἀκοσμῇ, μέχρι μὲν ἑκατὸν δραχμῶν νομίσματος αὐτοὺς εἶναι κυρίους διαδικάζοντας, μέχρι δὲ διπλασίου τούτου κοινῇ μετὰ ἀστυνόμων ζημιοῦν δικάζοντας τῷ ἀδικοῦντι.
And the market-wardens must guard the order concerning the marketplace prescribed by laws, and take care of the temples and fountains in the marketplace, so that no one does any injustice, and punish the one who does injustice, with blows and bonds a slave and a foreigner, but if anyone being a citizen is disorderly concerning such things, they themselves shall have authority to judge and fine up to a hundred drachmas of money, and up to double of this, they shall fine the wrongdoer by judging jointly with the city-wardens.
τὰ αὐτὰ δὲ καὶ ἀστυνόμοις ἔστω ζημιώματά τε καὶ κολάσεις ἐν τῇ ἑαυτῶν ἀρχῇ, μέχρι μὲν μνᾶς αὐτοὺς ζημιοῦντας, τὴν διπλασίαν δὲ μετὰ ἀγορανόμων.
And let there be the same fines and punishments for the city-wardens in their own office, they themselves fining up to a mina, and double that amount jointly with the market-wardens.
μουσικῆς δὲ τὸ μετὰ τοῦτο καὶ γυμναστικῆς ἄρχοντας καθίστασθαι πρέπον ἂν εἴη, διττοὺς ἑκατέρων, τοὺς μὲν παιδείας αὐτῶν ἕνεκα, τοὺς δὲ ἀγωνιστικῆς.
And after this, it would be proper for officials of music and gymnastics to be appointed, two kinds of each, some for their education, and others for athletic competition.
παιδείας μὲν βούλεται λέγειν ὁ νόμος γυμνασίων καὶ διδασκαλείων ἐπιμελητὰς κόσμου καὶ παιδεύσεως ἅμα καὶ τῆς περὶ ταῦτα ἐπιμελείας τῶν φοιτήσεών τε πέρι καὶ οἰκήσεων ἀρρένων καὶ θηλειῶν κορῶν, ἀγωνίας δέ, ἔν τε τοῖς γυμνικοῖς καὶ περὶ τὴν μουσικὴν ἀθλοθέτας ἀθληταῖς, διττοὺς αὖ τούτους, περὶ μουσικὴν μὲν ἑτέρους, περὶ ἀγωνίαν δʼ ἄλλους.
By education indeed the law wishes to mean supervisors of gymnasia and schools, both for their order and education, and for the care concerning these things, and about the attendance and lodging of boys and girls; and by competition, judges of athletes both in gymnastic contests and concerning music, these again being two kinds, some concerning music, and others concerning the athletic competition.
ἀγωνιστικῆς μὲν οὖν ἀνθρώπων τε καὶ ἵππων τοὺς αὐτούς, μουσικῆς δὲ ἑτέρους μὲν τοὺς περὶ μονῳδίαν τε καὶ μιμητικήν, οἷον ῥαψῳδῶν καὶ κιθαρῳδῶν καὶ αὐλητῶν καὶ πάντων τῶν τοιούτων ἀθλοθέτας ἑτέρους πρέπον ἂν εἴη γίγνεσθαι, τῶν δὲ περὶ χορῳδίαν ἄλλους.
Now of the athletic competition indeed, both of men and of horses, let the same men be in charge, but of music, it would be proper for some indeed to be judges of solo-singing and mimetic performance, such as of rhapsodists and citharists and flute-players and all such, and others to be of choral performance.
πρῶτον δὴ περὶ τὴν τῶν χορῶν παιδιὰν παίδων τε καὶ ἀνδρῶν καὶ θηλειῶν κορῶν ἐν ὀρχήσεσι καὶ τῇ τάξει τῇ ἁπάσῃ γιγνομένῃ μουσικῇ τοὺς ἄρχοντας αἱρεῖσθαί που χρεών· §6.765ΑΘ. ἱκανὸς δὲ εἷς ἄρχων αὐτοῖς, μὴ ἔλαττον τετταράκοντα γεγονὼς ἐτῶν.
First indeed, concerning the choral play of children and men and girls in dances and in all the established order of music, it is necessary to elect the officials; ATH.: And one official is sufficient for them, having become not less than forty years of age.
ἱκανὸς δὲ καὶ περὶ μονῳδίαν εἷς, μὴ ἔλαττον ἢ τριάκοντα γεγονὼς ἐτῶν, εἰσαγωγεύς τε εἶναι καὶ τοῖς ἁμιλλωμένοις τὴν διάκρισιν ἱκανῶς ἀποδιδούς.
And also one is sufficient concerning solo-singing, having become not less than thirty years of age, to be the introducer and sufficiently rendering the judgment to the competitors.
τὸν δὴ χορῶν ἄρχοντα καὶ διαθετῆρα αἱρεῖσθαι χρὴ τοιόνδε τινὰ τρόπον. ὅσοι μὲν φιλοφρόνως ἐσχήκασι περὶ τὰ τοιαῦτα, εἰς τὸν σύλλογον ἴτωσαν, ἐπιζήμιοι ἐὰν μὴ ἴωσιν—τούτου δὲ οἱ νομοφύλακες κριταί—τοῖς δʼ ἄλλοις, ἐὰν μὴ βούλωνται, μηδὲν ἐπάναγκες ἔστω.
The official and arranger of choruses indeed must be elected in some such manner as this: Let as many as have a friendly disposition concerning such things go to the assembly, being subject to a fine if they do not go—and of this the guardians of the laws shall be judges—but for the others, let it not be compulsory at all, if they do not wish.
καὶ τὴν προβολὴν δὴ τὸν αἱρούμενον ἐκ τῶν ἐμπείρων ποιητέον, ἔν τε τῇ δοκιμασίᾳ κατηγόρημα ἓν τοῦτʼ ἔστω καὶ ἀπηγόρημα, τῶν μὲν ὡς ἄπειρος ὁ λαχών, τῶν δʼ ὡς ἔμπειρος· ὃς δʼ ἂν εἷς ἐκ προχειροτονηθέντων δέκα λάχῃ, δοκιμασθείς, τὸν ἐνιαυτὸν τῶν χορῶν ἀρχέτω κατὰ νόμον.
And the elector must make the nomination from those who are experienced, and in the examination let this be one point of accusation and defense: on the one side that the one chosen by lot is inexperienced, and on the other that he is experienced; and whichever one is chosen by lot from the ten pre-voted, having been approved, let him rule the choruses for that year according to law.
κατὰ ταὐτὰ δὲ τούτοις καὶ ταύτῃ ὁ λαχὼν τὸν ἐνιαυτὸν ἐκεῖνον τῶν ἀφικομένων εἰς κρίσιν μονῳδιῶν τε καὶ συναυλιῶν ἀρχέτω, εἰς τοὺς κριτὰς ἀποδιδοὺς ὁ λαχὼν τὴν κρίσιν.
And in the same way as these and in this manner, let the one chosen by lot rule for that year those solo-singings and joint flute-playings that have come for judgment, and let the one chosen by lot submit the judgment to the judges.
μετὰ δὲ ταῦτα χρεὼν ἀγωνίας ἀθλοθέτας αἱρεῖσθαι τῆς περὶ τὰ γυμνάσια ἵππων τε καὶ ἀνθρώπων ἐκ τῶν τρίτων τε καὶ ἔτι τῶν δευτέρων τιμημάτων· εἰς δὲ τὴν αἵρεσιν ἔστω μὲν ἐπάναγκες τοῖς τρισὶν πορεύεσθαι τιμήμασι, τὸ σμικρότατον δὲ ἀζήμιον ἀφείσθω.
And after these things, it is necessary to elect judges of competition concerning gymnasia, of both horses and men, from the third and also the second property classes; and for the election let it be compulsory for the three classes to go, but let the smallest be dismissed without fine.
τρεῖς δʼ ἔστωσαν οἱ λαχόντες, τῶν προχειροτονηθέντων μὲν εἴκοσι, λαχόντων δὲ ἐκ τῶν εἴκοσι τριῶν, οὓς ἂν καὶ ψῆφος ἡ τῶν δοκιμαζόντων δοκιμάσῃ· ἐὰν δέ τις ἀποδοκιμασθῇ καθʼ ἡντιναοῦν ἀρχῆς λῆξιν καὶ κρίσιν, ἄλλους ἀνθαιρεῖσθαι κατὰ ταὐτὰ καὶ τὴν δοκιμασίαν ὡσαύτως αὐτῶν πέρι ποιεῖσθαι.
And let there be three chosen by lot, from the twenty pre-voted, and of the twenty, three being chosen by lot, whom also the vote of those who examine shall approve; and if anyone is disqualified in any allotment or judgment of office, let others be chosen in his stead in the same way, and let the examination concerning them be made in like manner.
λοιπὸς δὲ ἄρχων περὶ τὰ προειρημένα ἡμῖν ὁ τῆς παιδείας ἐπιμελητὴς πάσης θηλειῶν τε καὶ ἀρρένων.
And the remaining official concerning our aforementioned subjects is the supervisor of all education of both girls and boys.
εἷς μὲν δὴ καὶ ὁ τούτων ἄρξων ἔστω κατὰ νόμους, ἐτῶν μὲν γεγονὼς μὴ ἔλαττον ἢ πεντήκοντα, παίδων δὲ γνησίων πατήρ, μάλιστα μὲν ὑέων καὶ θυγατέρων, εἰ δὲ μή, θάτερα· διανοηθήτω δὲ αὐτός τε ὁ προκριθεὶς καὶ ὁ προκρίνων ὡς οὖσαν ταύτην τὴν ἀρχὴν τῶν ἐν τῇ πόλει ἀκροτάτων ἀρχῶν πολὺ μεγίστην.
Indeed, let there be one also to rule these according to laws, having become not less than fifty years of age, being a father of legitimate children, preferably of both sons and daughters, but if not, of either; and let both the one pre-selected and the pre-selector consider that this office is by far the greatest of the highest offices in the city.
