§8οἱ μὲν γὰρ αὐτῶν ἀπέστελλον ἐκ τῆς Αἰγύπτου τὰ χρήματα, οἱ δʼ ἐπέπλεον ταῖς ἐμπορίαις, οἱ δʼ ἐνθάδε μένοντες διετίθεντο τὰ ἀποστελλόμενα· εἶτα πρὸς τὰς καθεστηκυίας τιμὰς ἔπεμπον γράμματα οἱ ἐπιδημοῦντες τοῖς ἀποδημοῦσιν, ἵνα ἐὰν μὲν παρʼ ὑμῖν τίμιος ᾖ ὁ σῖτος, δεῦρο αὐτὸν κομίσωσιν, ἐὰν δʼ εὐωνότερος γένηται, εἰς ἄλλο τι καταπλεύσωσιν ἐμπόριον.
For some of them dispatched money from Egypt, others sailed with the cargoes, and others, remaining here, disposed of what was sent; then those residing here sent letters to those abroad regarding the prevailing prices, in order that, if grain were dear with you, they might bring it here, but if it became cheaper, they might sail into some other port.
ὅθεν περ οὐχ ἥκιστα, ὦ ἄνδρες δικασταί, συνετιμήθη τὰ περὶ τὸν σῖτον ἐκ τῶν τοιούτων ἐπιστολῶν καὶ συνεργιῶν. §9ὅτε μὲν οὖν ἐνθένδε ἀπέστελλον οὗτοι τὴν ναῦν, ἐπιεικῶς ἔντιμον κατέλιπον τὸν σῖτον· διὸ καὶ ὑπέμειναν ἐν τῇ συγγραφῇ γράψασθαι εἰς Ἀθήνας πλεῖν, εἰς δʼ ἄλλο μηδὲν ἐμπόριον.
It was from this very cause, men of the jury, and from such letters and cooperations, that the price of grain was not least inflated. Now when these men dispatched the ship from here, they left grain reasonably high; wherefore they also submitted to write in the agreement to sail to Athens and to no other port.
μετὰ δὲ ταῦτα, ὦ ἄνδρες δικασταί, ἐπειδὴ ὁ Σικελικὸς κατάπλους ἐγένετο καὶ αἱ τιμαὶ τοῦ σίτου ἐπʼ ἔλαττον ἐβάδιζον καὶ ἡ ναῦς ἡ τούτων ἀνῆκτο εἰς Αἴγυπτον, εὐθέως οὗτος ἀποστέλλει τινὰ εἰς τὴν Ῥόδον ἀπαγγελοῦντα τῷ Παρμενίσκῳ τῷ κοινωνῷ τὰ ἐνθένδε καθεστηκότα, ἀκριβῶς εἰδὼς ὅτι ἀναγκαῖον εἴη τῇ νηὶ προσσχεῖν εἰς Ῥόδον. §10πέρας δʼ οὖν, λαβὼν γὰρ ὁ Παρμενίσκος ὁ τουτουὶ κοινωνὸς τὰ γράμματα τὰ παρὰ τούτου ἀποσταλέντα, καὶ πυθόμενος τὰς τιμὰς τὰς ἐνθάδε καθεστηκυίας, ἐξαιρεῖται τὸν σῖτον ἐν τῇ Ῥόδῳ κἀκεῖ ἀποδίδοται, καταφρονήσαντες μὲν τῆς συγγραφῆς, ὦ ἄνδρες δικασταί, καὶ τῶν ἐπιτιμίων, ἃ συνεγράψαντο αὐτοὶ οὗτοι καθʼ αὑτῶν, ἐάν τι παραβαίνωσιν, καταφρονήσαντες δὲ τῶν νόμων τῶν ὑμετέρων, οἳ κελεύουσι τοὺς ναυκλήρους καὶ τοὺς ἐπιβάτας πλεῖν εἰς ὅ τι ἂν συνθῶνται ἐμπόριον, εἰ δὲ μή, ταῖς μεγίσταις ζημίαις εἶναι ἐνόχους. §11καὶ ἡμεῖς ἐπειδὴ τάχιστα ἐπυθόμεθα τὸ γεγονός, ἐκπεπληγμένοι τῷ πράγματι προσῇμεν τούτῳ τῷ ἀρχιτέκτονι τῆς ὅλης ἐπιβουλῆς, ἀγανακτοῦντες, οἷον εἰκός, καὶ ἐγκαλοῦντες ὅτι διαρρήδην ἡμῶν διορισαμένων ἐν ταῖς συνθήκαις ὅπως ἡ ναῦς μηδαμόσε καταπλεύσεται ἀλλʼ ἢ εἰς Ἀθήνας, καὶ ἐπὶ ταύταις ταῖς ὁμολογίαις δανεισάντων τὸ ἀργύριον, ἡμᾶς μὲν ἐν ὑποψίᾳ καταλέλοιπεν τοῖς βουλομένοις αἰτιᾶσθαι καὶ λέγειν, ὡς ἄρα καὶ ἡμεῖς κεκοινωνήκαμεν τῆς σιτηγίας τῆς εἰς τὴν Ῥόδον, αὐτοὶ δὲ οὐδὲν μᾶλλον τὴν ναῦν ἥκουσι κατακομίζοντες εἰς τὸ ὑμέτερον ἐμπόριον εἰς ὃ συνεγράψαντο.
But after this, men of the jury, when the Sicilian fleet arrived and the prices of grain began to fall, and their ship had set sail for Egypt, this man immediately dispatched someone to Rhodes to report to Parmeniscus, his partner, the situation established here, knowing precisely that it would be necessary for the ship to touch at Rhodes. In the end, then, Parmeniscus, this man's partner, having received the letters sent by him and having learned the prices established here, unloaded the grain in Rhodes and sold it there, holding in contempt, men of the jury, the agreement and the penalties which they themselves had written down against themselves in case they should violate it, and holding in contempt your laws, which command shipowners and passengers to sail to whatever port they have agreed upon, or else to be liable to the greatest penalties. And as soon as we heard of what had happened, being shocked by the business, we went to this architect of the whole plot, being indignant, as was natural, and accusing him that, although we had explicitly specified in the contract that the ship should sail nowhere else but to Athens, and had lent our money on these terms, he had left us under suspicion to those who wished to accuse us and say that we too had shared in the importation of grain to Rhodes, while they themselves were in no way returning with the ship to your port to which they had contracted to sail. But when we achieved nothing by discussing the agreement and our rights, we demanded to receive back at least the loan and the interest originally agreed upon.
§12ἐπειδὴ δὲ οὐδὲν ἐπεραίνομεν ὑπὲρ τῆς συγγραφῆς καὶ τῶν δικαίων διαλεγόμενοι, ἀλλὰ τό γε δάνειον καὶ τοὺς τόκους ἠξιοῦμεν ἀπολαβεῖν τοὺς ἐξ ἀρχῆς ὁμολογηθέντας. οὗτος δὲ οὕτως ὑβριστικῶς ἐχρήσατο ἡμῖν, ὥστε τοὺς μὲν τόκους τοὺς ἐν τῇ συγγραφῇ γεγραμμένους οὐκ ἔφη δώσειν· εἰ δὲ βούλεσθε,
ἔφη,
κομίζεσθαι τὸ πρὸς μέρος τοῦ πλοῦ τοῦ πεπλευσμένου, δώσω ὑμῖν
φησὶν
τοὺς εἰς Ῥόδον τόκους· πλείους δʼ οὐκ ἂν δοίην
, αὐτὸς ἑαυτῷ νομοθετῶν καὶ οὐχὶ τοῖς ἐκ τῆς συγγραφῆς δικαίοις πειθόμενος. §13ὡς δʼ ἡμεῖς οὐκ ἂν ἔφαμεν συγχωρῆσαι οὐδὲν τούτων, λογιζόμενοι ὅτι, ὁπότε τοῦτο πράξομεν, ὁμολογοῦμεν καὶ αὐτοὶ εἰς Ῥόδον σεσιτηγηκέναι, ἔτι μᾶλλον ἐπέτεινεν οὗτος καὶ μάρτυρας πολλοὺς παραλαβὼν προσῄει, φάσκων ἕτοιμος εἶναι ἀποδιδόναι τὸ δάνειον καὶ τοὺς τόκους τοὺς εἰς Ῥόδον, οὐδὲν μᾶλλον, ὦ ἄνδρες δικασταί, ἀποδοῦναι διανοούμενος, ἀλλʼ ἡμᾶς ὑπολαμβάνων οὐκ ἂν ἐθελῆσαι λαβεῖν τὸ ἀργύριον διὰ τὰς ὑπούσας αἰτίας.
He, however, treated us so insultingly that he declared he would not pay the interest written in the agreement; "but if you wish," he said, "to recover a portion proportional to the voyage sailed, I will give you," says he, "the interest to Rhodes; but more than that I will not give," making laws for himself and not obeying the rights arising from the agreement. And when we said we would agree to none of these terms, reflecting that, if we did so, we should be admitting that we too had transported grain to Rhodes, this man became still more aggressive, and having taken many witnesses with him, came forward, claiming to be ready to pay back the loan and the interest to Rhodes, with no more intention, men of the jury, of paying it, but supposing that we would not be willing to receive the money because of the underlying causes.
ἐδήλωσε δὲ αὐτὸ τὸ ἔργον.
And his very conduct proved this.
