§29εἰ δʼ ἄρʼ ἠγνόησε ταῦτα, καὶ τοῦτο τὸ δίκαιον ἔχων, ὡς νῦν φήσει, οὐ παρεσκευάσατʼ ὑπὲρ τηλικούτου κινδύνου, ἐπειδή γʼ ἀνεστηκὼς ἤδη προσεκαλεσάμην αὐτόν, ἐν τῇ πρώτῃ συνόδῳ πρὸς τῷ διαιτητῇ παραδιδοὺς ἐφαίνετʼ ἄν· ὧν οὐδὲν πέπρακται τούτῳ.
But if, after all, he was ignorant of these things, and though having this right—as he will now claim—did not prepare for so great a danger, yet when I, having already arisen from bed, summoned him, at the very first meeting before the arbitrator he would have been seen handing over the slaves; of which things nothing has been done by this man.
ὅτι δʼ ἀληθῆ λέγω καὶ διακρούσεως ἕνεχʼ ἡ πρόκλησις ἦν, λέγε ταύτην τὴν μαρτυρίαν· ἔσται γὰρ ἐκ ταύτης φανερόν. ΜΑΡΤΥΡΙΑ.
And to show that I speak the truth and that the challenge was for the sake of delay, read this testimony; for from it, it will be clear. ΜΑΡΤΥΡΙΑ.
§30περὶ μὲν τοίνυν τῆς βασάνου ταῦτα μέμνησθε, τὴν ὥραν ἡνίκα προὐκαλεῖτο, ὧν ἕνεκʼ ἐκκρούων ταῦτʼ ἐποίει, τοὺς χρόνους τοὺς πρώτους, ἐν οἷς οὐδαμοῦ τοῦτο βουληθεὶς τὸ δίκαιον αὑτῷ γενέσθαι φαίνεται, οὐδὲ προκαλεσάμενος, οὐδʼ ἀξιώσας.
Concerning the torture, then, remember these things: the hour when he challenged, for the sake of what delay he did these things, and the first period, in which he is nowhere seen wishing this right to be yours or his, neither challenging nor demanding it.
ἐπειδὴ τοίνυν ταὐτὰ πάντʼ ἠλέγχεθʼ ἅπερ καὶ νῦν, πρὸς τῷ διαιτητῇ, καὶ φανερῶς ἐδείκνυτο πᾶσιν ὢν ἔνοχος τοῖς ἐγκεκλημένοις, §31ἐμβάλλεται μαρτυρίαν ψευδῆ καὶ ἐπιγράφεται μάρτυρας ἀνθρώπους οὓς οὐδʼ ὑμᾶς ἀγνοήσειν οἴομαι, ἐὰν ἀκούσητε,
Διότιμος Διοτίμου Ἰκαριεύς, Ἀρχεβιάδης Δημοτέλους Ἁλαιεύς, Χαιρήτιος Χαιριμένους Πιθεὺς μαρτυροῦσιν ἀπιέναι ἀπὸ δείπνου μετὰ Κόνωνος, καὶ προσελθεῖν ἐν ἀγορᾷ μαχομένοις Ἀρίστωνι καὶ τῷ υἱεῖ τῷ Κόνωνος, §32καὶ μὴ πατάξαι Κόνωνα Ἀρίστωνα
, ὡς ὑμᾶς εὐθέως πιστεύσοντας, τὸ δʼ ἀληθὲς οὐ λογιουμένους, ὅτι πρῶτον μὲν οὐδέποτʼ ἂν οὔθʼ ὁ Λυσίστρατος οὔθʼ ὁ Πασέας οὔθʼ ὁ Νικήρατος οὔθʼ ὁ Διόδωρος, οἳ διαρρήδην μεμαρτυρήκασιν ὁρᾶν ὑπὸ Κόνωνος τυπτόμενον ἐμὲ καὶ θοἰμάτιον ἐκδυόμενον καὶ τἄλλʼ ὅσʼ ἔπασχον ὑβριζόμενον, ἀγνῶτες ὄντες κἀπὸ ταὐτομάτου παραγενόμενοι τῷ πράγματι τὰ ψευδῆ μαρτυρεῖν ἠθέλησαν, εἰ μὴ ταῦθʼ ἑώρων πεπονθότα·
When, therefore, all these same things were being proved against him, just as now, before the arbitrator, and he was clearly shown to all to be liable to all the charges, he threw in a false testimony and registered witnesses, men whom I think not even you will fail to recognize if you hear them: "Diotimus, son of Diotimus, of Icaria; Archebiades, son of Demoteles, of Halae; Chaeretius, son of Chaerimenes, of Pithus, testify that they were returning from dinner with Conon, and came upon Ariston and the son of Conon fighting in the marketplace, and that Conon did not strike Ariston," as if you would immediately believe them, and would not consider the truth, that first of all, neither Lysistratus, nor Paseas, nor Niceratus, nor Diodorus—who have explicitly testified that they saw me being beaten by Conon, my cloak being stripped, and all the other things I suffered in being insulted—would ever, being strangers and having come upon the matter by chance, have wished to testify falsely, if they had not seen me suffering these things; and secondly, I myself would never, not having suffered these things from this man, have chosen to pass over those who are admitted even by themselves to have beaten me, and proceed first against one who did not even touch me.
ἔπειτʼ αὐτὸς ἐγὼ οὐδέποτʼ ἄν, μὴ παθὼν ὑπὸ τούτου ταῦτα, ἀφεὶς τοὺς καὶ παρʼ αὐτῶν τούτων ὁμολογουμένους τύπτειν ἐμὲ πρὸς τὸν οὐδʼ ἁψάμενον πρῶτον εἰσιέναι προειλόμην. §33τί γὰρ ἄν;
For why would I?
ἀλλʼ ὑφʼ οὗ γε πρώτου ἐπλήγην καὶ μάλισθʼ ὑβρίσθην, τούτῳ καὶ δικάζομαι καὶ μισῶ καὶ ἐπεξέρχομαι.
Rather, against him by whom I was first struck and most insulted, against him I bring suit, and hate, and prosecute.
καὶ τὰ μὲν παρʼ ἐμοῦ πάνθʼ οὕτως ἐστὶν ἀληθῆ καὶ φαίνεται· τούτῳ δὲ μὴ παρασχομένῳ τούτους μάρτυρας ἦν δήπου λόγος οὐδείς, ἀλλʼ ἑαλωκέναι παραχρῆμʼ ὑπῆρχε σιωπῇ.
And everything on my part is thus true and appears so; but for this man, if he had not provided these witnesses, there was surely no defense, but he would have stood immediately convicted in silence.
συμπόται δʼ ὄντες τούτου καὶ πολλῶν τοιούτων ἔργων κοινωνοὶ εἰκότως τὰ ψευδῆ μεμαρτυρήκασιν.
And being his drinking companions and sharers in many such deeds, they have reasonably testified falsely.
εἰ δʼ ἔσται τὸ πρᾶγμα τοιοῦτον, ἐὰν ἅπαξ ἀπαναισχυντήσωσίν τινες καὶ τὰ ψευδῆ φανερῶς τολμήσωσι μαρτυρεῖν, οὐδὲν δὲ τῆς ἀληθείας ὄφελος, πάνδεινον ἔσται πρᾶγμα.
But if the matter is to be such, if once some people throw off all shame and dare to testify falsely openly, and there is no help in the truth, it will be a most terrible business.
§34ἀλλὰ νὴ Δίʼ οὐκ εἰσὶ τοιοῦτοι.
But by Zeus, they are not such men!
ἀλλʼ ἴσασιν ὑμῶν, ὡς ἐγὼ νομίζω, πολλοὶ καὶ τὸν Διότιμον καὶ τὸν Ἀρχεβιάδην καὶ τὸν Χαιρήτιον τὸν ἐπιπόλιον τουτονί, οἳ μεθʼ ἡμέραν μὲν ἐσκυθρωπάκασιν καὶ λακωνίζειν φασὶ καὶ τρίβωνας ἔχουσιν καὶ ἁπλᾶς ὑποδέδενται, ἐπειδὰν δὲ συλλεγῶσιν καὶ μετʼ ἀλλήλων γένωνται, κακῶν καὶ αἰσχρῶν οὐδὲν ἐλλείπουσι.
Yet many of you, I think, know both Diotimus and Archebiades and this gray-haired Chaeretius here, who by day look gloomy and claim to lead Spartan lives, wearing coarse cloaks and wearing single-soled sandals, but when they gather and get together, they leave out nothing of wickedness and baseness.
§35καὶ ταῦτα τὰ λαμπρὰ καὶ νεανικά ἐστιν αὐτῶν
οὐ γὰρ ἡμεῖς μαρτυρήσομεν ἀλλήλοις;
And these are their brilliant and youthful acts: "Shall we not testify for one another?
οὐ γὰρ ταῦθʼ ἑταίρων ἐστὶ καὶ φίλων;
For is this not the way of comrades and friends?
τί δὲ καὶ δεινόν ἐστιν ὧν παρέξεται κατὰ σοῦ;
And what is even terrible about the things he will bring against you?
τυπτόμενόν φασί τινες ὁρᾶν;
Some people say they saw you being beaten?
ἡμεῖς δὲ μηδʼ ἧφθαι τὸ παράπαν μαρτυρήσομεν.
We will testify that you were not even touched at all.
ἐκδεδύσθαι θοἰμάτιον;
Your cloak was stripped off?
τοῦτʼ ἐκείνους προτέρους πεποιηκέναι ἡμεῖς μαρτυρήσομεν.
We will testify that they did this first.
τὸ χεῖλος ἐρράφθαι;
Your lip was sewn up?
τὴν κεφαλὴν δέ γʼ ἡμεῖς ἢ ἕτερόν τι κατεαγέναι φήσομεν. §36ἀλλὰ καὶ μάρτυρας ἰατροὺς παρέχομαι. τοῦτʼ οὐκ ἔστιν, ὦ ἄνδρες δικασταί, παρὰ τούτοις· ὅσα γὰρ μὴ διʼ αὑτῶν, οὐδενὸς μάρτυρος καθʼ ἡμῶν εὐπορήσουσιν.
We will say that your head or something else was broken." "But I also provide doctors as witnesses." This is not so, gentlemen of the jury, with these men; for except for what they do through themselves, they will not find any witness against us.
ἡ δʼ ἀπʼ αὐτῶν ἑτοιμότης οὐδʼ ἂν εἰπεῖν μὰ τοὺς θεοὺς δυναίμην ὅση καὶ οἵα πρὸς τὸ ποιεῖν ὁτιοῦν ὑπάρχει.
And by the gods, I could not even tell you how great and of what kind their readiness is to do anything.
ἵνα δʼ εἰδῆθʼ οἷα καὶ διαπραττόμενοι περιέρχονται, λέγʼ αὐτοῖς ταυτασὶ τὰς μαρτυρίας, σὺ δʼ ἐπίλαβε τὸ ὕδωρ. ΜΑΡΤΥΡΙΑΙ.
But so that you may know what kind of things they go about committing, read these testimonies to them, and you, stop the water. ΜΑΡΤΥΡΙΑΙ.
§37τοίχους τοίνυν διορύττοντες καὶ παίοντες τοὺς ἀπαντῶντας, ἆρʼ ἂν ὑμῖν ὀκνῆσαι δοκοῦσιν ἐν γραμματειδίῳ τὰ ψευδῆ μαρτυρεῖν ἀλλήλοις οἱ κεκοινωνηκότες τοσαύτης καὶ τοιαύτης φιλαπεχθημοσύνης καὶ πονηρίας καὶ ἀναιδείας καὶ ὕβρεως;
Therefore, house-breakers who beat those they meet, do you think they would hesitate to testify falsely for one another on a little tablet, having shared in so much and such hostility, wickedness, shamelessness, and insolence?
πάντα γὰρ ταῦτʼ ἔμοιγʼ ἐν τοῖς ὑπὸ τούτων πραττομένοις ἐνεῖναι δοκεῖ.
For all these things, to me at least, seem to be present in the deeds committed by them.
καίτοι καὶ τούτων ἕτερʼ ἐστὶν πεπραγμένα τούτοις δεινότερα, ἀλλʼ ἡμεῖς οὐχ οἷοί τε γενοίμεθʼ ἂν πάντας ἐξευρεῖν τοὺς ἠδικημένους.
And yet other things have been done by them more terrible than these, but we would not be able to find out all those who have been wronged.
