§1μηδενὶ ὑμῶν ἄπιστον γενέσθω, ὦ ἄνδρες δικασταί, εἰ Τιμόθεος ὀφείλων ἀργύριον τῷ πατρὶ τῷ ἐμῷ φεύγει νῦν ὑπʼ ἐμοῦ ταύτην τὴν δίκην.
Let none of you, men of the jury, find it incredible if Timotheus, though owing money to my father, is now being sued by me in this lawsuit.
ἀλλʼ ἐπειδὰν ὑμᾶς ἀναμνήσω τόν τε καιρὸν ἐν ᾧ τὸ συμβόλαιον ἐγένετο, καὶ τὰ συμβάντα τούτῳ ἐν ἐκείνῳ τῷ χρόνῳ, καὶ εἰς ὅσην ἀπορίαν κατέστη οὗτος, τότε ἡγήσεσθε τὸν μὲν πατέρα τὸν ἐμὸν βέλτιστον γενέσθαι περὶ Τιμόθεον, τοῦτον δὲ οὐ μόνον ἀχάριστον εἶναι, ἀλλὰ καὶ ἀδικώτατον πάντων ἀνθρώπων, §2ὅς γε τυχὼν παρὰ τοῦ πατρὸς τοῦ ἐμοῦ ὅσων ἐδεήθη καὶ λαβὼν ἀργύριον ἀπὸ τῆς τραπέζης, ἐν πολλῇ ἀπορίᾳ ὢν κἀν κινδύνοις τοῖς μεγίστοις καθεστηκὼς περὶ τῆς ψυχῆς, οὐ μόνον οὐκ ἀπέδωκε χάριν, ἀλλὰ καὶ τὸ δοθὲν ἀποστερεῖ με.
But when I remind you of both the occasion on which the transaction took place, and the circumstances that befell him at that time, and into how great distress he was cast, then you will consider that my father was most generous towards Timotheus, and that this man is not only ungrateful but also the most unjust of all men, who, having obtained from my father as much as he needed and having received money from the bank, though being in great distress and established in the greatest dangers concerning his life, not only returned no gratitude, but is even trying to deprive me of what was given.
καίτοι σφαλέντος μὲν τούτου ἀπώλλυτο καὶ τῷ πατρὶ τῷ ἐμῷ τὸ συμβόλαιον· οὔτε γὰρ ἐπʼ ἐνεχύρῳ οὔτε μετὰ μαρτύρων ἔδωκεν· σωθέντος δὲ ἐπὶ τούτῳ ἐγίγνετο, ὁπότε βούλοιτο εὐπορήσας ἡμῖν ἀποδοῦναι.
And yet, if he had failed, the transaction would have been lost to my father as well; for he gave it neither on security nor with witnesses; but since he was saved, it depended on him, whenever he should prosper, to return it to us if he wished.
§3ἀλλʼ ὅμως, ὦ ἄνδρες δικασταί, οὐ περὶ πλείονος ἐποιήσατο ὁ πατὴρ περιουσίαν χρημάτων μᾶλλον ἢ οὐ Τιμοθέῳ ὑπηρετῆσαι ὧν ἐδεήθη αὐτοῦ, ἐν ἀπορίᾳ ὄντι.
But nevertheless, men of the jury, my father did not value the abundance of his wealth more than serving Timotheus in what he begged of him, when he was in distress.
ᾤετο μὲν οὖν, ὦ ἄνδρες δικασταί, ὁ πατήρ, εἰ σωθείη Τιμόθεος τότε ἐξ ἐκείνων τῶν κινδύνων καὶ ἀφίκοιτο οἴκαδε παρὰ βασιλέως, εὐπορωτέρου γενομένου τούτου ἢ ὡς τότε διέκειτο, οὐ μόνον τὰ ἑαυτοῦ κομιεῖσθαι, ἀλλὰ καὶ ἄλλου εἴ του δέοιτο πρὸς Τιμόθεον πρᾶξαι ὑπάρξειν αὑτῷ.
My father, therefore, men of the jury, thought that if Timotheus should be saved then from those dangers and arrive home from the King, since he would become more prosperous than he was then situated, he would not only recover his own, but also that if he needed to negotiate any other matter with Timotheus, it would be open to him.
§4ἐπειδὴ δὲ οὐχ ὡς ἐκεῖνος ᾠήθη συμβέβηκεν, ἀλλʼ ἃ μετὰ χάριτος ἔλαβεν Τιμόθεος ἀπὸ τῆς τραπέζης δεηθεὶς τοῦ πατρὸς τοῦ ἐμοῦ, ταῦτα διʼ ἔχθρας καὶ δίκης τετελευτηκότος ἐκείνου ἐξελεγχθεὶς μὲν ὡς ὀφείλει οἴεται δεῖν ἀποδοῦναι, ἐὰν δὲ δύνηται ὑμᾶς πεῖσαι ὡς οὐκ ὀφείλει, ἐξαπατήσας τῷ λόγῳ, ἀποστερῆσαι ἡμᾶς τῶν χρημάτων, ἀναγκαῖόν μοι δοκεῖ εἶναι ἐξ ἀρχῆς ἅπαντα διηγήσασθαι ὑμῖν, τά τε ὀφειλόμενα, καὶ εἰς ὅ τι ἕκαστον αὐτῶν κατεχρήσατο, καὶ τοὺς χρόνους ἐν οἷς τὸ συμβόλαιον ἐγένετο.
But since things did not turn out as he thought, but rather those things which Timotheus received with gratitude from the bank after begging my father, these things, now that my father has died, through hostility and a lawsuit, though on the one hand he thinks he must pay them back if he is proved to owe them, yet on the other hand, if he can persuade you that he does not owe them, by deceiving you with his speech, he intends to deprive us of the money, it seems necessary to me to narrate everything to you from the beginning: the debts, and for what purpose he used each of them, and the times at which the transaction took place.
§5θαυμάσῃ δὲ μηδεὶς ὑμῶν εἰ ἀκριβῶς ἴσμεν· οἱ γὰρ τραπεζῖται εἰώθασιν ὑπομνήματα γράφεσθαι ὧν τε διδόασιν χρημάτων καὶ εἰς ὅ τι καὶ ὧν ἄν τις τιθῆται, ἵνα ᾖ αὐτοῖς γνώριμα τά τε ληφθέντα καὶ τὰ τεθέντα πρὸς τοὺς λογισμούς.
And let none of you wonder if we know accurately; for bankers are accustomed to write down memoranda of what money they give and for what purpose, and of what anyone deposits, so that both what has been received and what has been deposited may be known to them for their accounts.
§6ἐπὶ Σωκρατίδου γὰρ ἄρχοντος μουνιχιῶνος μηνὸς μέλλων ἐκπλεῖν τὸν ὕστερον ἔκπλουν Τιμόθεος οὑτοσί, περὶ ἀναγωγὴν ἤδη ὢν ἐν τῷ Πειραιεῖ, προσδεηθεὶς ἀργυρίου, προσελθὼν τῷ πατρὶ τῷ ἐμῷ ἐν τῷ λιμένι, ἐκέλευσεν αὐτὸν χρῆσαι χιλίας τριακοσίας πεντήκοντα μίαν δύʼ ὀβολώ· τοσούτου γὰρ ἔφη προσδεῖσθαι· καὶ δοῦναι ἐκέλευσεν Ἀντιμάχῳ τῷ ταμίᾳ τῷ ἑαυτοῦ, ὃς τούτῳ διῴκει τότε πάντα.
For in the archonship of Socratides, in the month of Munychion, when this Timotheus was about to sail out on his later expedition, being already about to put to sea at the Piraeus, needing more money, he came to my father in the harbor and asked him to lend him one thousand three hundred and fifty-one drachmas and two obols—for he said he needed so much more—and he asked him to give it to Antimachus, his treasurer, who was then managing all his affairs for him.
§7καὶ ὁ μὲν δανεισάμενος τὸ ἀργύριον παρὰ τοῦ πατρὸς τοῦ ἐμοῦ Τιμόθεος ἦν καὶ κελεύσας δοῦναι Ἀντιμάχῳ τῷ ταμίᾳ τῷ ἑαυτοῦ, ὁ δὲ λαβὼν τὸ ἀργύριον ἀπὸ τῆς τραπέζης παρὰ Φορμίωνος Αὐτόνομος, ὅσπερ Ἀντιμάχῳ διετέλει γραμματεύων τὸν ἅπαντα χρόνον.
And the one who borrowed the money from my father and ordered it to be given to Antimachus, his treasurer, was Timotheus, while the one who received the money from the bank from Phormio was Autonomus, who continuously served as Antimachus' scribe during the entire time.
§8δοθέντος τοίνυν τοῦ ἀργυρίου τούτου ἐγράψατο μὲν ὀφείλοντα τὸν κελεύσαντα χρῆσαι Τιμόθεον, ὑπόμνημα δὲ ἐγράψατο, ᾧ τε οὗτος ἐκέλευσε δοῦναι, Ἀντιμάχῳ, καὶ ὃν ὁ Ἀντίμαχος συνέπεμψεν ἐπὶ τὴν τράπεζαν ληψόμενον τὸ ἀργύριον, τὸν Αὐτόνομον, τὰς χιλίας τριακοσίας δραχμὰς καὶ πεντήκοντα καὶ μίαν καὶ δύʼ ὀβολώ.
When this money was given, therefore, my father wrote down Timotheus, who had asked for the loan, as owing it, and wrote a memorandum of Antimachus, whom this man had ordered to receive it, and of Autonomus, whom Antimachus sent to the bank to receive the money, for the sum of one thousand three hundred and fifty-one drachmas and two obols.
τὸ μὲν τοίνυν πρῶτον χρέως, ὃ ἐκπλέων ἔλαβεν στρατηγῶν τὸ ὕστερον, τοσοῦτον ὀφείλει.
The first debt, therefore, which he received when sailing out as general on his later expedition, is this much that he owes.
