αὕτη ἐστίν, ὦ ἄνδρες δικασταί, ἡ Ἀριστονόη τοῦ Φιλοστράτου θυγάτηρ, μήτηρ δὲ τουτουί.
This, gentlemen of the jury, is Aristonoe, the daughter of Philostratus and the mother of this man here.
ταύτῃ χρέως φησὶν ὀφείλεσθαι Φαίνιππος τὴν προῖκα, ἧς οἱ νόμοι κύριον τοῦτον ποιοῦσιν, ψευδόμενος καὶ οὐ δικαίως χρώμενος τῇ ἀποφάσει.
Phaenippus claims that he owes her the dowry as a debt, whereas the laws make him the master of it, lying and making an unjust use of the declaration.
διὰ τί γὰρ ἐγώ, Φαίνιππε, μενούσης μοι τῆς μητρὸς ἐν τῷ οἴκῳ καὶ ζώσης καὶ προῖκα ἐπενεγκαμένης, οὐκ ἀπογράφω τὴν προῖκα χρέως αὐτῇ, οὐδὲ παρακρούομαι τοὺς δικαστάς, ἀλλʼ ἐῶ μετέχειν τῶν ἐμαυτοῦ τὴν μητέρα, ἄν τε τὴν Φαινίππου ἄν τε τὴν ἐμαυτοῦ ἔχω οὐσίαν;
For why is it, Phaenippus, that although my mother remains in my house and is alive, and brought a dowry with her, I do not register the dowry as a debt to her, nor do I mislead the judges, but I allow my mother to share in my possessions, whether I have the estate of Phaenippus or my own?
ὅτι οἱ νόμοι ταῦτα κελεύουσιν, ὦ βέλτιστε· σὺ δὲ πάντα ποιεῖς παρὰ τοὺς νόμους.
Because the laws command this, my good sir; but you do everything contrary to the laws.

§28ἀκούετε, ὦ ἄνδρες δικασταί·
Hear, gentlemen of the jury.
Παμφίλῳ φησὶν καὶ Φειδόλεῳ Ῥαμνουσίοις κοινῇ τάλαντον ἐνοφείλειν καὶ Αἰαντίδῃ Φλυεῖ τετρακισχιλίας καὶ Ἀριστομένει Ἀναγυρασίῳ τέτταρας καὶ δέκα μνᾶς.
He claims to owe a talent jointly to Pamphilus and Pheidoleus of Rhamnus, and four thousand drachmae to Aeantides of Phlya, and fourteen minae to Aristomenes of Anagyrus.
διὰ τί οὖν, Φαίνιππε, ὅτε μὲν ἐγὼ μάρτυρας ἔχων ἠρώτων σε, εἴ τι ὀφείλεις ἐπὶ τῇ ἐσχατιᾷ, καὶ ἐκέλευον δεῖξαι ὅρον εἴ που ἔπεστι, καὶ διεμαρτυρόμην ὅπως μή μοι ὕστερον κατεσκευασμένοι δανεισταὶ φανήσονται, τότε μὲν οὐδὲν ἀπέφηνας τῶν χρεῶν, ἐπειδὴ δὲ δευτέρῳ μηνὶ τὴν ἀπόφασιν ἔδωκάς μοι, τοῦ νόμου κελεύοντος τριῶν ἡμερῶν, νῦν ἥκουσι δανεισταὶ καὶ ὀφειλήματα πλέον ἢ τριῶν ταλάντων;
Why is it then, Phaenippus, that when I, with witnesses, asked you if you owed anything on the security of the estate, and bade you show me a mortgage-stone if there was one anywhere, and protested so that fabricated creditors might not appear against me later—why did you then declare none of these debts, but now, when you gave me the declaration in the second month, though the law commands it within three days, there now appear creditors and debts of more than three talents?
§29ὅτι, ὦ βέλτιστε, οὐδὲν ἄλλο κατασκευάζεις ἢ ὅσονπερ κοινῇ γέγονέ μοι πρὸς τὴν πόλιν ὄφλημα, τοσοῦτο καὶ σοὶ ἰδίᾳ νῦν εἶναι.
Because, my good sir, you are fabricating nothing other than this: that as large a debt as I have incurred to the city in public, just as much should now be owed by you in private.
ὅτι δʼ, ὦ Φαίνιππε, ψεύδει καὶ ἐπιωρκηκὼς ἥκεις πρὸς τούτους, ἤδη φανερῶς ἐλέγξω.
But that you are lying, Phaenippus, and have come before these men having committed perjury, I will now clearly prove.
λαβέ μοι, γραμματεῦ, τὴν τοῦ Αἰαντίδου καὶ Θεοτέλους μαρτυρίαν, οἷς οὗτος ἀπογέγραφεν ὀφείλονθʼ αὑτὸν τετρακισχιλίας δραχμὰς ψευδόμενος καὶ πάλαι ἀποδεδωκώς, οὐχ ἑκών, ἀλλὰ δίκην ὀφλών.
Clerk, take for me the testimony of Aeantides and Theoteles, to whom this man has declared himself to owe four thousand drachmae, lying, since he paid it back long ago—not voluntarily, but having lost a lawsuit.

§30ἔπειτʼ, ἄνδρες δικασταί, τὸν οὕτω καταφανῶς ἐν ἅπασιν ἀδίκως πεποιημένον τὴν ἀπόφασιν, καὶ μήτε τῶν νόμων φροντίσαντα μηδέν, οἳ διωρίκασιν ἐν οἷς δεῖ τὴν ἀπόφασιν ποιεῖσθαι χρόνοις, μήτε τῶν ἰδίων ὁμολογιῶν, ἃς ὁμοίως ὑπολαμβάνομεν ἰσχυράς, χωρὶς δὲ τούτων ἀνεῳχότα τὰ σημεῖα τῶν οἰκημάτων καὶ ἐκπεφορηκότα τὸν σῖτον καὶ τὸν οἶνον ἔνδοθεν, πρὸς δὲ τούτοις τὴν ὕλην τὴν τετμημένην πεπρακότα μετὰ τὴν ἀντίδοσιν, πλέον ἢ τριάκοντα μνῶν οὖσαν ἀξίαν, καὶ τὸ πάντων μέγιστον, χρέα ψευδῆ κατεσκευακότα τῆς ἀντιδόσεως ἕνεκα, τοῦτον δικαίως ψηφιεῖσθε πεποιῆσθαι τὴν ἀπόφασιν;
Then, gentlemen of the jury, will you vote that this man has made his declaration justly—a man who has so glaringly in all respects made an unjust declaration, and paid no regard either to the laws, which have specified the times within which the declaration must be made, or to his private agreements, which we likewise consider binding, and besides these, has opened the seals of the buildings and carried away the corn and the wine from within, and in addition to this, has sold the cut timber after the challenge to exchange, which was worth more than thirty minae, and what is greatest of all, has fabricated false debts for the sake of the exchange—will you vote that he has made his declaration justly?
μηδαμῶς, ὦ ἄνδρες δικασταί.
By no means, gentlemen of the jury.
§31ποῖ γὰρ τραπέσθαι δεήσει διαμαρτόντα τῆς ὑμετέρας γνώμης, ὅταν οἱ πλούσιοι καὶ μηδὲν ὑμῖν πώποτε χρήσιμοι γεγενημένοι, πολὺν καὶ σῖτον καὶ οἶνον ποιοῦντες καὶ τοῦτον τριπλασίας τιμῆς ἢ πρότερον διατιθέμενοι, πλεονεκτῶσιν παρʼ ὑμῖν;
For where will one have to turn, if I fail to obtain your favorable judgment, when the rich, who have never been of any use to you, though they produce much grain and wine and sell it at three times the former price, enjoy an advantage among you?
ὃ μηδαμῶς νυνὶ γενέσθω, ἀλλʼ ὥσπερ καὶ κοινῇ πᾶσιν βεβοηθήκατε τοῖς ἐν τοῖς ἔργοις ἐργαζομένοις, οὕτω καὶ ἰδίᾳ βοηθήσατέ μοι νῦν.
Let this by no means happen now, but just as you have publicly helped all those working in the mines, so now help me privately.
§32καὶ γὰρ εἰ οἰκέτης ὑμῶν, μὴ πολίτης ἦν, ὁρῶντες ἄν μου τὴν φιλεργίαν καὶ τὴν εἰς ὑμᾶς εὔνοιαν, ἀνεπαύσατʼ ἄν με τῶν ἀναλωμάτων καὶ ἐπὶ τὸν δραπετεύοντα τῶν ἄλλων ἤλθετε.
For even if I were your slave and not a citizen, seeing my industry and my goodwill towards you, you would have relieved me of these expenses and gone after one of the others who is trying to escape.
τὸν αὐτὸν τρόπον καὶ νῦν, ἐπειδὰν ἀποτείσω τὰ τρία τάλανθʼ ἃ ὦφλον καὶ ἀναλάβω ἐμαυτόν, πάλιν ἀναπαύσαντες τῶν τεταλαιπωρηκότων ἕτερον ἐπʼ ἔμʼ ἥξετε· νῦν δʼ ἄφετε, ἱκετεύω πάντας ὑμᾶς, ἄνδρες δικασταί, καὶ τὰ δίκαιʼ εἰρηκὼς δέομαι βοηθῆσαί μοι καὶ μή με περιελαθέντα περιιδεῖν ὑπὸ τούτων.
In the same way now, when I have paid the three talents which I was fined and have recovered myself, you may come to me again after relieving one of those who have been exhausted; but now release me, I entreat you all, gentlemen of the jury, and as I have spoken what is just, I beg you to help me and not to allow me to be driven to ruin by these men.
