§13καίτοι, ὦ ἄνδρες δικασταί, τίς οὐκ οἶδεν ὑμῶν, ὅτι ὁμοίως ἥ τε ἐν τῷ νόμῳ γεγραμμένη κυρία ἐστὶν ἡμέρα καὶ ἡ ὑπὸ τῶν ἀντιδίκων συγχωρηθεῖσα;
And yet, gentlemen of the jury, who among you does not know that a day agreed upon by the litigants is just as binding as the one written in the law?
πολλάκις γὰρ ἔν τε τοῖς νόμοις γεγραμμένης τριακοστῆς ἡμέρας ἑτέραν ἡμῖν αὐτοῖς συγχωρήσαντες ἐθέμεθα, παρά τε ταῖς ἀρχαῖς ἁπάσαις καὶ δίκας καὶ κρίσεις ἀναβάλλονται τοῖς ἀντιδίκοις οἱ ἄρχοντες συγχωρησάντων ἐκείνων ἀλλήλοις·
For indeed, we have often, by mutual agreement, set another day for ourselves when the thirtieth day was written in the laws; and before all the magistrates, they postpone both private suits and public trials for the litigants when they have agreed with one another.
ὧν εἴ τις ἄκυρον ἡγήσαιτο δεῖν εἶναι τὴν πρὸς ἀλλήλους ὁμολογίαν, μισήσαιτʼ ἂν αὐτὸν ὡς ὑπερβάλλοντα συκοφαντίᾳ.
If anyone should think that a mutual agreement of this kind ought to be invalid, you would hate him as one exceeding in malicious prosecution.
§14Φαίνιππος τοίνυν, ὥσπερ τοῦ νόμου προστάττοντος μηδὲν ποιεῖν ὧν ἂν ὁμολογήσῃ τις, ἀπʼ ἐκείνης τῆς ἡμέρας, ἀφʼ ἧς ὡμολόγησεν ἐπί τε τὰς διαλύσεις ἀπαντήσεσθαι καὶ τὴν ἀπόφασίν μοι τὴν αὑτοῦ δώσειν καὶ τὴν παρʼ ἐμοῦ λήψεσθαι, οὐδεπώποτʼ ἀπήντησεν·
Phaenippus, then, as if the law commanded him to do nothing of what he has agreed to, has never appeared since that day on which he agreed to meet for the settlement, to give me his inventory, and to receive mine.
ἀλλʼ ἐγὼ μὲν ἐπειδὴ τοῦτον ἑώρων οὐ προσέχοντά μοι τὸν νοῦν οὐδὲ τοῖς νόμοις, εἰς τὸ στρατήγιον ἔδωκα τὴν ἀπόφασιν, οὗτος δέ, ὅπερ καὶ μικρῷ πρότερον εἶπον, πρῴην ἔδωκέ μοι βιβλίον, οὐδὲν ἄλλο βουλόμενος ἢ δοκεῖν μὲν δεδωκέναι τὴν ἀπόφασιν, μὴ ἔχειν δέ με τοῖς ἐν αὐτῷ γεγραμμένοις ὅ τι χρήσομαι.
But when I saw that he paid attention neither to me nor to the laws, I delivered my inventory to the office of the generals; whereas he, as I said a moment ago, delivered a document to me only the day before yesterday, wishing nothing else than to appear to have delivered his inventory, while ensuring that I should have no way to make use of what was written in it.
§15χρὴ δʼ, ὦ ἄνδρες δικασταί, μὴ τοῖς ἰσχυροτέραν νομίζουσι τῶν νόμων τὴν αὑτῶν βδελυρίαν εἶναι, πλέον τούτοις τοῦ δικαίου νέμειν (εἰ δὲ μή, πολλοὺς ποιήσετε τοὺς καταγελῶντας τῶν ἐν τοῖς νόμοις δικαίων γεγραμμένων), ἀλλʼ ἐκείνοις βοηθεῖν, οἵτινες ἂν τὴν τῶν νόμων φωνὴν ὑμετέραν εἶναι νομίζωσι, καὶ τὴν ἡμέραν ταύτην, τὴν εἰς τὸ δικαστήριον, ὑπὲρ τῶν ἠδικημένων εἶναι, μὴ τῶν ἠδικηκότων.
And you must not, gentlemen of the jury, award more than what is just to those who think their own baseness is stronger than the laws (otherwise, you will make many who mock the justice written in the laws), but you must aid those who believe that the voice of the laws is your voice, and that this day in court should be for the victims of injustice, not for those who committed it.

§17πῶς οὖν ἄλλως πρὸς τῶν θεῶν καὶ δαιμόνων, ὦ ἄνδρες δικασταί, ἐπιδεικνύειν ὑμῖν δεῖ Φαίνιππον ἔνοχον ὄντα τοῖς ἀνεγνωσμένοις ἢ ὅνπερ τρόπον ἐγὼ νῦν ἐπιδεικνύω;
How else, by the gods and spirits, gentlemen of the jury, ought I to demonstrate to you that Phaenippus is liable to the laws that have been read, than in the manner I am doing now?
ἀλλʼ ὅμως ἐμὲ ἀντεγράψατο Φαίνιππος μὴ δικαίως ἀποφαίνειν τὴν οὐσίαν· οὕτω τὸ πρὸς ὑμᾶς ψεύδεσθαι τοῖς τοιούτοις ῥᾴδιόν ἐστιν·
And yet Phaenippus filed a counter-declaration against me, claiming that I do not declare my property justly; so easy is it for such men to lie to you.
καὶ κατηγορεῖ τοῦ ὅρκου ὃν ὤμοσα πρὸ τῆς ἀποφάσεως, λέγων ὅτι πλὴν τῶν ἐν τοῖς ἔργοις ὑπεσχόμην ἀποφαίνειν τὴν ἄλλην οὐσίαν, ὥσπερ τὸ κατὰ τοὺς νόμους ὀμνύειν, τοῦτʼ ἄξιον κατηγορίας ὄν.
And he finds fault with the oath which I swore before the declaration, saying that I promised to declare my other property except for that in the works, as if swearing in accordance with the laws were a matter worthy of accusation.
§18ὑμεῖς δʼ ἴστε, ὦ ἄνδρες δικασταί (ὑμεῖς γὰρ ἔθεσθε) τὸν νόμον, ὃς διαρρήδην οὕτω λέγει,
τοὺς δʼ ἀντιδιδόντας ἀλλήλοις, ὅταν ὀμόσαντες ἀποφαίνωσι τὴν οὐσίαν, προσομνύειν τόνδε τὸν ὅρκον
ἀποφαίνω τὴν οὐσίαν τὴν ἐμαυτοῦ ὀρθῶς καὶ δικαίως, πλὴν τῶν ἐν τοῖς ἔργοις τοῖς ἀργυρείοις, ὅσα οἱ νόμοι ἀτελῆ πεποιήκασι
. §19μᾶλλον δὲ λέγε τὸν νόμον αὐτόν.
But you know, gentlemen of the jury (for you enacted it), the law which explicitly speaks as follows: "And those who make exchange of property with one another, when they declare their property after taking the oath, shall take this additional oath: 'I declare my own property rightly and justly, except for that in the silver works, as many as the laws have made tax-free.'" Rather, read the law itself.
μικρὸν μὲν οὖν ἱκετεύω ἐπίσχες.
But wait, I entreat you, for a moment.
ἐγὼ γὰρ καὶ πρότερον προὐκαλεσάμην Φαίνιππον, καὶ νῦν, ὦ ἄνδρες δικασταί, δίδωμι αὐτῷ δωρεὰν καὶ ἀφίσταμαι μετὰ τῆς ἄλλης οὐσίας καὶ τῶν ἐν τοῖς ἔργοις, ἐάν μοι τὴν ἐσχατιὰν μόνην ἐλευθέραν παραδῷ, ὥσπερ ἦν ὅτʼ ἐγὼ τὸ πρῶτον ἦλθον εἰς αὐτὴν μετὰ μαρτύρων, καὶ ἐάν, ὃν ἐξῆχεν ἐκ τῶν οἰκημάτων σῖτον καὶ οἶνον καὶ τἄλλα, ἀφελὼν ἀπὸ τῶν θυρῶν τὰ σημεῖα, ταῦτα πάλιν εἰς ταὐτὸ καταστήσῃ.
For I have challenged Phaenippus before, and now, gentlemen of the jury, I make him a free gift and withdraw in his favor with the rest of my property and the assets in the works, if he will only deliver the estate to me free of debt, just as it was when I first went to it with witnesses, and if, having removed the seals from the doors, he will restore to the same place the barley, wine, and other things which he carried away from the buildings.
