§22λέγε δʼ αὐτὸ τὸ ἔγκλημα, ὅ μοι δικάζεται.
Read the indictment itself, on which he is suing me.
ΕΓΚΛΗΜΑ.
"ἔβλαψέ με Νικόβουλος ἐπιβουλεύσας ἐμοὶ καὶ τῇ οὐσίᾳ τῇ ἐμῇ, ἀφελέσθαι κελεύσας Ἀντιγένην τὸν ἑαυτοῦ οἰκέτην τὸ ἀργύριον τοῦ ἐμοῦ οἰκέτου, ὃ ἔφερεν καταβολὴν τῇ πόλει τοῦ μετάλλου, ὃ ἐγὼ ἐπριάμην ἐνενήκοντα μνῶν, καὶ αἴτιος ἐμοὶ γενόμενος ἐγγραφῆναι τὸ διπλοῦν τῷ δημοσίῳ. " §23ἐπίσχες.
INDICTMENT. "Nicobulus harmed me by conspiring against me and my property, having ordered his own slave Antigenes to take away from my slave the money which he was carrying as an installment to the state for the mine, which I bought for ninety minae, and having caused me to be registered for double the amount in the public treasury." Stop.
ταυτὶ πάντα, ἃ νῦν ἐγκέκληκεν ἐμοί, πρότερον τὸν Εὔεργον αἰτιασάμενος τὴν δίκην εἷλε.
On all these points which he has now charged against me, he previously accused Euergos and won his suit.
μεμαρτύρηται μὲν δὴ καὶ ἐν ἀρχῇ μοι τοῦ λόγου πρὸς ὑμᾶς ὡς ἀπεδήμουν, ὅτε τούτοις αἱ πρὸς ἀλλήλους ἐγίγνοντο διαφοραί· οὐ μὴν ἀλλὰ καὶ ἐκ τοῦ ἐγκλήματος τούτου δῆλόν ἐστιν.
Indeed, it has been testified to you at the beginning of my speech that I was abroad when their disputes with one another occurred; nevertheless, it is also clear from this very indictment.
οὐδαμοῦ γὰρ ὡς ἐγώ τι πεποίηκα τούτων ἔγραψεν, ἀλλʼ ὑπογράψας ἐπιβουλεῦσαί με αὑτῷ καὶ τῇ οὐσίᾳ, προστάξαι φησὶ τῷ παιδὶ ταῦτα ποιεῖν, ψευδόμενος· πῶς γὰρ ἐγὼ προσέταξα, ὃς ὅτʼ ἐξέπλεον τῶν γενησομένων ἐνταῦθʼ οὐδʼ ὁτιοῦν δήπουθεν ᾔδειν;
For nowhere has he written that I did any of these things, but having insinuated that I conspired against him and his property, he says that I ordered my servant to do these things, therein lying; for how could I have given such an order, since when I sailed away I knew absolutely nothing of what was going to happen here?
§24εἶτα καὶ πόση μωρία, λέγονθʼ ὡς ἐπεβούλευον ἀτιμῶσαι καὶ τὰ ἔσχατα πρᾶξαι, οἰκέτῃ με ταῦτα προστάξαι γεγραφέναι, ἃ οὐδὲ πολίτης πολίτην δύναιτʼ ἂν ποιῆσαι;
And then, what folly, while claiming that I conspired to deprive him of his civic rights and bring extreme ruin upon him, to have written in the indictment that I ordered a slave to do things which not even a citizen could do to a fellow citizen!
τί οὖν ἐστι τοῦτο;
What, then, is the meaning of this?
οὐκ ἔχων οἶμαι κατʼ οὐδὲν διὰ τὴν ἀποδημίαν εἰς ἐμὲ τούτων ἀνενεγκεῖν τι, συκοφαντεῖν δὲ βουλόμενος, ὡς προσέταξα, ἐνέγραψεν· οὐδὲ γὰρ λόγος ἦν, εἰ μὴ τοῦτʼ ἐποίησε.
Since he had no way, I believe, because of my absence abroad, to connect any of these acts directly to me, but wished to bring a malicious suit, he wrote in that "I ordered it"; for his charge would have made no sense if he had not done this.

"καὶ ἐπειδὴ ὦφλον ἐγὼ τῷ δημοσίῳ, καταστήσας Ἀντιγένην τὸν ἑαυτοῦ οἰκέτην εἰς τὸ ἐργαστήριον τὸ ἐμὸν τὸ ἐπὶ Θρασύλλῳ κύριον τῶν ἐμῶν, ἀπαγορεύοντος ἐμοῦ. "
ἐπίσχες.
INDICTMENT. "And when I had become indebted to the treasury, he, despite my forbidding it, installed his slave Antigenes in my workshop near the monument of Thrasyllus as master of my property." Stop.
πάλιν ταυτὶ πάνθʼ ὑπʼ αὐτοῦ τοῦ πράγματος ἐξελεγχθήσεται ψευδόμενος.
Here again, all this will be proved false by the facts themselves.
γέγραφεν γὰρ καταστῆσαι μὲν ἐμέ, ἀπαγορεύειν δʼ αὑτόν.
For he has written that I installed the slave, and that he himself forbade it.
ταῦτα δʼ οὐχ οἷόν τε τὸν μὴ παρόντα.
But these things are impossible for one who was not present.
οὔτε γὰρ καθίστην ἐγώ, ὅ γʼ ὢν ἐν τῷ Πόντῳ, οὔτʼ ἀπηγόρευεν οὗτος τῷ μὴ παρόντι· πῶς γάρ;
For neither did I install him, being in the Pontus, nor did he forbid one who was not present; for how could he?
§26πῶς οὖν εἰς ἀνάγκην ἦλθεν ταῦθʼ οὕτω γράψαι;
How then did he come to be forced to write this in this way?
ὁ Εὔεργος τότʼ οἶμαι πλημμελῶν ὧν δέδωκε δίκην, συνήθως ἔχων ἐμοὶ καὶ γνώριμος ὢν κατέστησεν τὸν οἰκέτην οἴκοθεν λαβὼν παρʼ ἐμοῦ φυλάττειν ὡς αὑτόν.
Euergos, I believe, who was then committing the offenses for which he has since paid the penalty, being an associate and acquaintance of mine, took the slave from my house and installed him to keep guard as though he were his own.
εἰ μὲν οὖν ἔγραψε τἀληθές, γέλως ἂν ἦν· τί γάρ, εἰ κατέστησεν Εὔεργος, ἐγώ σʼ ἀδικῶ;
Now, if he had written the truth, it would have been a laughing-stock; for what wrong do I do you if Euergos installed him?
φεύγων δὲ τοῦτο τοιαῦτʼ ἠνάγκασται γράφειν, ἵνʼ ᾖ πρὸς ἔμʼ αὐτῷ τὸ ἔγκλημα.
Avoiding this, he has been forced to write such things so that his charge might lie against me.

"κἄπειτα πείσας τοὺς οἰκέτας τοὺς ἐμοὺς καθέζεσθαι εἰς τὸν κεγχρεῶνα ἐπὶ βλάβῃ τῇ ἐμῇ. " §27τουτὶ παντελῶς ἤδη καὶ ἀναιδές ἐστιν· οὐ γὰρ μόνον ἐκ τοῦ προκαλεῖσθαι τούτους παραδοῦναι, τοῦτον δὲ μὴ ʼθέλειν, ἀλλὰ καὶ ἐκ πάντων δῆλόν ἐστιν ψεῦδος ὄν.
INDICTMENT. "And then, having persuaded my slaves to sit as suppliants in the refining-room to my injury." This is now utterly impudent; for not only from my having challenged him to deliver these slaves and his refusal to do so, but from all the circumstances, it is clear that this is a lie.
τίνος γὰρ εἵνεκʼ ἔπειθον;
For what reason should I have persuaded them?
ἵνα νὴ Δίʼ αὐτοὺς κτήσωμαι.
In order, by Zeus, that I might possess them?
ἀλλʼ αἱρέσεώς μοι δοθείσης ἢ ἔχειν ἢ κομίσασθαι τὰ ἐμαυτοῦ, εἱλόμην κομίσασθαι, καὶ ταῦτα μεμαρτύρηται.
But when the choice was given to me either to hold them or to recover my money, I chose to recover my money, and this has been testified.
λέγε δὴ τὴν πρόκλησιν ὅμως.

INDICTMENT. "And having refined the silver ore which my slaves had worked, and keeping the silver obtained from this ore." Again, how is it possible for these things to have been done by me, who was not present, and concerning matters for which you got Euergos convicted?
