Demosthenes · For Phormion §9-15

Division of Estate and Apollodorus' Release of Phormio

Passage 2 of 8 · Greek

Summary

The speaker explains how the estate was divided and why Apollodorus chose the safer shield factory over the bank, while also showing that Apollodorus had previously accepted a settlement for minor claims and released Phormio from all liabilities.

And they divided the rest of the estate, except for what this man had leased; and they paid him half of the income from these leased properties.
ἄχρι μὲν οὖν τούτου τοῦ χρόνου πῶς ἔνεστʼ ἐγκαλεῖν αὐτῷ μισθώσεως;
Up to that time, then, how is it possible to bring any charge against him regarding the lease?
For he ought to have shown his displeasure not now, but immediately back then.
Moreover, it is not even possible for him to say that he has not received the rents that subsequently fell due.
For you would never, when this man here was released from the lease upon Pasicles being admitted to his citizenship, have released him from all claims, but you would have demanded payment immediately at that time if he owed you anything.
To prove, therefore, that I am speaking the truth, and that this man divided the estate with his brother who was still a child, and that they released Phormio from the lease and all other claims, take this deposition. [DEPOSITION] Immediately, then, men of Athens, as they released this man from the lease, they divided the bank and the shield-manufactory, and Apollodorus, having been given his choice, chose the shield-manufactory instead of the bank.
καίτοι εἰ ἦν ἰδία τις ἀφορμὴ τούτῳ πρὸς τῇ τραπέζῃ, τί δή ποτʼ ἂν εἵλετο τοῦτο μᾶλλον ἢ ʼκείνην;
Yet if there had been any private working capital belonging to him in the bank, why on earth would he have chosen the factory rather than the bank?
For the income was not greater, but less (the factory brought in one talent, the bank one hundred minae), nor was the property more desirable, if private funds had been attached to the bank.
But there were none.
Therefore, acting wisely, this man chose the shield-manufactory; for that property is free from risk, whereas the bank is a business yielding risky returns from other people's money.
One could say and point out many indications that this man is bringing a malicious suit in claiming working capital.
But I think the greatest proof of all that this man here received no working capital for these purposes is that it was written in the lease that Pasion owed an additional sum to the bank, and had not given working capital to him; secondly, that this man is shown to have made no complaint at the time of the division; and thirdly, that when he afterwards leased these same properties to others for the same amount of money, he will not be found to have leased any private working capital with them.
And yet, if he had been deprived by this man of what his father had provided, he himself ought now to have provided it from other sources and given it to those tenants.
To prove, therefore, that I am speaking the truth, and that he afterwards leased the business to Xenon, Euphraeus, Euphron, and Callistratus, and did not hand over any private working capital to them either, but that they leased the deposits and the business itself derived from them, please take their deposition, and also the proof of how he chose the shield-manufactory. [DEPOSITION] It has been testified to you, then, men of Athens, that they leased the business to these men also and did not hand over any private working capital, and that they released them as having been greatly benefited, and did not bring any suit either against them at that time or against this man.
So long, then, as his mother was alive, who knew all these details accurately, Apollodorus never made any complaint against Phormio here; but when she died, he harassed him with false accusations, claiming three thousand silver drachmae in addition to the two thousand which she had given to Phormio's children, as well as a small tunic and a maidservant.
And even then, he will not be found mentioning any of the matters for which he now brings suit.
But having referred the matter to his own wife's father, to his own brother-in-law, and to Lysinus and Andromenes, and these men having persuaded Phormio here to make a gift of the three thousand drachmae and the additional items, and to have him as a friend rather than be an enemy on account of these things, he received five thousand drachmae in all, and went to the temple of Athena and for the second time released him from all claims.

Notes

  1. 9ὧν — Attraction of the relative pronoun. The genitive demonstrative antecedent τούτων is omitted, and the relative pronoun ἃ (accusative object of ἐμεμίσθωτο) is attracted into the genitive case ὧν because of the preposition πλὴν.
  2. 10οὐ γὰρ ἄν ποτʼ... ἀφήκατʼ ἂν — An apodosis of a past contrary-to-fact condition, consisting of the indicative past (ἀφήκατε) with the particle ἄν. It expresses that something would never have happened in the past.
In this context, τοῦτο refers to the nearer object (the shield-manufactory mentioned just before) and ἐκείνην refers to the remoter one (the bank).
  4. 12τοῦ μηδεμίαν λαβεῖν ἀφορμὴν εἰς ταῦτα τουτονὶ — An articular infinitive in the genitive case (τοῦ λαβεῖν) modifying the noun τεκμήριον. The accusative τουτονὶ functions as the subject accusative of the infinitive, and μηδεμίαν ἀφορμὴν as its object.
