§62λαβόντες δὲ καὶ τἄλλʼ αἰσχρῶς οὑτωσὶ πάντα, πλέον ἢ τὰ ἡμίσεα τῶν χρημάτων μηδὲ καταλειφθῆναι κοινῇ πάντες ἀμφισβητοῦσιν, ὡς πεντεταλάντου δὲ μόνον τῆς οὐσίας οὔσης ἐκ τοσαύτης τοὺς λόγους ἀπενηνόχασιν, οὐ πρόσοδον μὲν ἐξ αὐτῶν οὐκ ἀποφαίνοντες, τὰ δὲ κεφάλαια φανερὰ ἀποδεικνύντες, ἀλλʼ αὐτὰ τὰ ἀρχαῖʼ οὕτως ἀναιδῶς ἀνηλῶσθαι φάσκοντες.
Having also seized all the rest of my property in this shameful manner, they all jointly contend that more than half of the funds were not even left behind at all; and they have rendered their accounts as though the estate had been of only five talents instead of so large an amount, not showing any income from them, nor proving where the capital went, but claiming that the capital itself was thus shamelessly spent.
καὶ οὐδʼ αἰσχύνονται ταῦτα τολμῶντες.
And they are not even ashamed of such audacity.
§63καίτοι τί ποτʼ ἂν ἔπαθον ὑπʼ αὐτῶν, εἰ πλείω χρόνον ἐπετροπεύθην;
And yet, what on earth would have happened to me at their hands, if I had been under guardianship for a longer time?
οὐκ ἂν ἔχοιεν εἰπεῖν.
They would not be able to say.
ὅπου γὰρ δέκʼ ἐτῶν διαγενομένων παρὰ μὲν τῶν οὕτω μικρὰ κεκόμισμαι, τῷ δὲ καὶ πρὸς ὀφείλων ἐγγέγραμμαι, πῶς οὐκ ἄξιον διαγανακτεῖν;
For when, after ten years have passed, I have recovered so little from some, and have even been registered as owing money to the other, how is it not right to be deeply indignant?
δῆλον δὲ παντάπασιν· εἰ κατελείφθην μὲν ἐνιαύσιος, ἓξ ἔτη δὲ πρὸς ἐπετροπεύθην ὑπʼ αὐτῶν, οὐδʼ ἂν τὰ μικρὰ ταῦτα παρʼ αὐτῶν ἀπέλαβον.
It is entirely clear: if I had been left an infant of one year, and had been under their guardianship for six years more, I would not have received even this little from them.
εἰ γὰρ ἐκεῖνʼ ἀνήλωται ὀρθῶς, οὐδὲν ἂν τῶν νῦν παραδοθέντων ἐξήρκεσεν εἰς ἕκτον ἔτος, ἀλλʼ ἢ παρʼ αὑτῶν ἄν μʼ ἔτρεφον ἢ τῷ λιμῷ περιεῖδον ἀπολόμενον.
For if those expenses were correctly spent, none of the things now delivered to me would have sufficed for a sixth year, but they would either have had to support me from their own means, or would have allowed me to perish of hunger.
§64καίτοι πῶς οὐ δεινόν, εἰ ἕτεροι μὲν οἶκοι ταλαντιαῖοι καὶ διτάλαντοι καταλειφθέντες ἐκ τοῦ μισθωθῆναι διπλάσιοι καὶ τριπλάσιοι γεγόνασιν, ὥστʼ ἀξιοῦσθαι λῃτουργεῖν, ὁ δʼ ἐμὸς τριηραρχεῖν εἰθισμένος καὶ μεγάλας εἰσφορὰς εἰσφέρειν μηδὲ μικρὰς δυνήσεται διὰ τὰς τούτων ἀναισχυντίας;
And yet, how is it not monstrous, if other estates left at one or two talents have become double and triple by being leased, so as to be deemed worthy of public liturgies, whereas mine, which was accustomed to maintain triremes and pay large war taxes, will not be able to pay even small ones because of their shamelessness?
τίνας δʼ οὗτοι λελοίπασιν ὑπερβολὰς εἰπεῖν;
What extremes of wickedness have these men left unspoken?
οἳ καὶ τὴν διαθήκην ἠφανίκασιν ὡς λήσοντες, καὶ τὰς μὲν σφετέρας αὐτῶν οὐσίας ἐκ τῶν ἐπικαρπιῶν διῳκήκασι καὶ τἀρχαῖα τῶν ὑπαρχόντων ἐκ τῶν ἐμῶν πολλῷ μείζω πεποιήκασι, τῆς δʼ ἐμῆς οὐσίας, ὥσπερ τὰ μέγισθʼ ὑφʼ ἡμῶν ἀδικηθέντες, ὅλον τὸ κεφάλαιον ἀνῃρήκασι.
They who have even made the will disappear, thinking they would escape detection, and have managed their own estates from the revenues and made their existing capital much larger out of my property, while of my estate, as though they had been wronged by us in the highest degree, they have destroyed the entire capital.
§65καὶ ὑμεῖς μὲν οὐδὲ τῶν εἰς ὑμᾶς ἁμαρτανόντων ὅταν τινὸς καταψηφίσησθε, οὐ πάντα τὰ ὄντʼ ἀφείλεσθε, ἀλλʼ ἢ γυναῖκας ἢ παιδίʼ αὐτῶν ἐλεήσαντες μέρος τι κἀκείνοις ὑπελίπετε· οὗτοι δὲ τοσοῦτον διαφέρουσιν ὑμῶν, ὥστε καὶ δωρεὰς παρʼ ἡμῶν προσλαβόντες ἵνα δικαίως ἐπιτροπεύσωσι, τοιαῦτʼ εἰς ἡμᾶς ὑβρίκασι.
And while you, when you condemn any of those who offend against you, do not deprive them of all their property, but pitying their wives or children, leave some part even for them; these men are so different from you that, although they received gifts from us besides, in order that they might act justly as guardians, they have committed such outrages against us.
καὶ οὐδʼ ᾐσχύνθησαν, εἰ μὴ ἠλέησαν, τὴν ἐμὴν ἀδελφήν, εἰ δυοῖν ταλάντοιν ὑπὸ τοῦ πατρὸς ἀξιωθεῖσα, μηδενὸς τεύξεται τῶν προσηκόντων, ἀλλʼ ὥσπερ ἔχθιστοί τινες, ἀλλʼ οὐ φίλοι καὶ συγγενεῖς καταλειφθέντες οὐδὲν τῆς οἰκειότητος ἐφρόντισαν.
And they were not even ashamed, even if they did not pity her, of my sister, who, having been deemed worthy of two talents by my father, will obtain none of her proper rights; but as if they had been left as bitterest enemies, and not as friends and kinsmen, they have paid no regard to the relationship.
§66ἀλλʼ ἐγὼ μὲν ὁ πάντων ταλαιπωρότατος πρὸς ἀμφότερʼ ἀπορῶ, ταύτην θʼ ὅπως ἐκδῶ καὶ τἄλλʼ ὁπόθεν διοικῶ.
But I, the most miserable of all men, am at a loss on both counts: how to marry her off, and from what source to manage the rest of my affairs.
προσεπίκειται δʼ ἡ πόλις ἀξιοῦσʼ εἰσφέρειν, δικαίως· οὐσίαν γὰρ ἱκανὴν πρὸς ταῦτα κατέλιπέν μοι ὁ πατήρ.
Moreover, the city presses upon me, demanding that I pay taxes, and justly so; for my father left me an estate sufficient for these things.
τὰ δὲ χρήματα τὰ καταλειφθένθʼ οὗτοι πάντʼ εἰλήφασιν.
But the funds that were left behind, these men have taken all.
§67καὶ νῦν κομίσασθαι τἀμαυτοῦ ζητῶν εἰς κίνδυνον καθέστηκα τὸν μέγιστον.
And now, in seeking to recover my own, I have run into the greatest danger.
ἂν γὰρ ἀποφύγῃ μʼ οὗτος, ὃ μὴ γένοιτο, τὴν ἐπωβελίαν ὀφλήσω μνᾶς ἑκατόν.
For if this man should be acquitted—which heaven forbid!—I shall owe the fine of the obol, a hundred minae.
καὶ τούτῳ μέν, ἐὰν καταψηφίσησθε, τιμητόν, κοὐκ ἐκ τῶν ἑαυτοῦ χρημάτων, ἀλλʼ ἐκ τῶν ἐμῶν ποιήσεται τὴν ἔκτεισιν· ἐμοὶ δʼ ἀτίμητον τοῦτʼ ἔστιν, ὥστʼ οὐ μόνον ἔσομαι τῶν πατρῴων ἀπεστερημένος, ἀλλὰ καὶ πρὸς ἠτιμωμένος, ἂν μὴ νῦν ἡμᾶς ὑμεῖς ἐλεήσητε.
And for him, if you convict him, the penalty is subject to assessment, and he will pay the fine not out of his own money, but out of mine; whereas for me this fine is fixed, so that I shall not only be deprived of my patrimony, but also disenfranchised in addition, unless you now take pity on us.
§68δέομαι οὖν ὑμῶν, ὦ ἄνδρες δικασταί, καὶ ἱκετεύω καὶ ἀντιβολῶ, μνησθέντας καὶ τῶν νόμων καὶ τῶν ὅρκων οὓς ὀμόσαντες δικάζετε, βοηθῆσαι ἡμῖν τὰ δίκαια, καὶ μὴ περὶ πλείονος τὰς τούτου δεήσεις ἢ τὰς ἡμετέρας ποιήσασθαι.
Therefore, I entreat you, men of the jury, and implore and supplicate you, remembering both the laws and the oaths under which you sit in judgment, to aid us in accordance with justice, and not to set a higher value on this man's entreaties than on ours.
δίκαιοι δʼ ἔστʼ ἐλεεῖν οὐ τοὺς ἀδίκους τῶν ἀνθρώπων, ἀλλὰ τοὺς παραλόγως δυστυχοῦντας, οὐδὲ τοὺς ὠμῶς οὕτως τἀλλότριʼ ἀποστεροῦντας, ἀλλʼ ἡμᾶς τοὺς πολὺν χρόνον ὧν ὁ πατὴρ ἡμῖν κατέλιπεν στερομένους καὶ πρὸς ὑπὸ τούτων ὑβριζομένους καὶ νῦν περὶ ἀτιμίας κινδυνεύοντας.
It is just for you to pity, not the unjust among men, but those who are unexpectedly unfortunate, and not those who so cruelly rob others of their property, but us who have for a long time been deprived of what our father left us, and have besides been outraged by these men, and are now in danger of disenfranchisement.
§69μέγα δʼ ἂν οἶμαι στενάξαι τὸν πατέρʼ ἡμῶν, εἰ αἴσθοιτο τῶν προικῶν καὶ τῶν δωρεῶν ὧν αὐτὸς τούτοις ἔδωκεν, ὑπὲρ τούτων τῆς ἐπωβελίας τὸν αὑτοῦ υἱὸν ἐμὲ κινδυνεύοντα, καὶ ἄλλους μέν τινας ἤδη τῶν πολιτῶν οὐ μόνον συγγενῶν, ἀλλὰ καὶ φίλων ἀνδρῶν ἀπορούντων θυγατέρας παρὰ σφῶν αὐτῶν ἐκδόντας, Ἄφοβον δὲ μηδʼ ἣν ἔλαβεν προῖκʼ ἐθέλοντʼ ἀποδοῦναι, καὶ ταῦτʼ ἔτει δεκάτῳ.
And deep, I think, would be the groan of our father, if he should perceive that because of the dowries and the gifts which he himself gave to these men, I, his own son, am in danger of the fine of the obol; and that while certain other citizens have ere now, out of their own means, portioned out the daughters of not only kinsmen but also of friends who were in distress, Aphobus is unwilling to return even the dowry which he received, and that in the tenth year.
