§47πῶς οὖν ἄν τις σαφέστερον ἐπιδείξειεν πάντα διηρπακότα καὶ μηδὲ τῶν μικρῶν ἀπεσχημένον, ἢ τοῦτον τὸν τρόπον ἐπιδεικνὺς μετὰ τοσούτων μαρτύρων καὶ τεκμηρίων;
How then could anyone demonstrate more clearly that he has plundered everything and has not abstained even from small things, than by demonstrating it in this manner with so many witnesses and proofs?
τὴν μὲν προῖκα λαβεῖν ὁμολογήσαντα καὶ ἔχειν αὐτὸν πρὸς τοὺς ἐπιτρόπους ἀπογράψαντα, τὸ δʼ ἐργαστήριον κεκαρπωμένον αὐτὸν καὶ τὴν πρόσοδον οὐκ ἀποφαίνοντα.
By demonstrating, on the one hand, that he confessed to have taken the dowry and holds it, having registered it with the other guardians, and on the other hand, that he has enjoyed the profit of the workshop and does not declare its income.
§48τῶν δʼ ἄλλων τὰ μὲν πεπρακότα καὶ τὰς τιμὰς οὐκ ἀποδεδωκότα, τὰ δʼ ὡς ἑαυτὸν λαβόντα καὶ ταῦτʼ ἠφανικότα, ἔτι δὲ παρὰ τὸν λόγον ὃν αὐτὸς ἀπέδωκε τοσαῦτα κλέπτοντα, πρὸς δὲ τούτοις τὴν διαθήκην ἠφανικότα, τὰ ἀνδράποδα πεπρακότα, τἄλλʼ οὕτω πάντα διῳκηκότα, ὡς οὐδʼ ἂν οἱ ἔχθιστοι διοικήσειαν;
And by demonstrating, as for the other things, that he has sold some and not returned the prices, and has taken others for himself and made them disappear, and furthermore, contrary to the account which he himself rendered, has stolen so much, and in addition to these, has made the will disappear, sold the slaves, and managed everything else in such a way as not even the bitterest enemies would manage it?
ἐγὼ μὲν οὐκ οἶδʼ ὅπως ἄν τις σαφέστερον ἐπιδείξειεν.
For my part, I do not know how anyone could demonstrate it more clearly.
§49ἐτόλμα τοίνυν πρὸς τῷ διαιτητῇ λέγειν, ὡς ἀπὸ τῶν χρημάτων χρέα τε πάμπολλʼ ἐκτέτεικεν ὑπὲρ ἐμοῦ Δημοφῶντι καὶ Θηριππίδῃ τοῖς συνεπιτρόποις, καὶ ὡς πολλὰ τῶν ἐμῶν λάβοιεν, οὐδέτερʼ ἔχων ἐπιδεικνύναι τούτων.
He had the audacity, then, to say before the arbitrator that out of the funds he has paid very many debts on my behalf to Demophon and Therippides, his co-guardians, and that they received many of my things, though he is able to demonstrate neither of these.
οὔτε γὰρ ὡς ὀφείλοντά με κατέλιπεν ὁ πατὴρ ἐν τοῖς γράμμασιν ἀπέφηνεν, οὐδʼ οἷς ἀποδεδωκέναι ταῦτʼ ἔφη παρέσχηται μάρτυρας, οὔτʼ αὖ τὸν ἀριθμὸν τῶν χρημάτων εἰς τοὺς συνεπιτρόπους ἐπανέφερεν ὅσον αὐτὸς φαίνεται λαβών, ἀλλὰ πολλοῖς ἐλάττω χρήμασιν.
For he neither showed in the documents that my father left me owing debts, nor has he provided witnesses to those whom he said he had paid these to, nor again did he refer to his co-guardians an amount of money as large as he himself is shown to have taken, but an amount less by many funds.
§50ἐρωτηθεὶς δʼ ὑπὸ τοῦ διαιτητοῦ ταῦτά τε καθʼ ἕκαστον, καὶ τὴν οὐσίαν τὴν αὑτοῦ πότερον ἐκ τῶν ἐπικαρπιῶν ἢ τἀρχαῖʼ ἀναλίσκων διῴκηκεν, καὶ πότερον ἐπιτροπευθεὶς ἀπεδέξατʼ ἂν τοῦτον τὸν λόγον παρὰ τῶν ἐπιτρόπων ἢ τἀρχαῖʼ ἂν ἀπολαβεῖν ἠξίου σὺν τοῖς ἔργοις τοῖς γεγενημένοις, πρὸς μὲν ταῦτʼ ἀπεκρίνατʼ οὐδέν, προὐκαλεῖτο δʼ ἐθέλειν ἐπιδεῖξαί μοι τὴν οὐσίαν δέκα ταλάντων οὖσαν· εἰ δέ τι ἐλλείποι, αὐτὸς ἔφη προσθήσειν.
And when asked by the arbitrator about each of these things, and whether he had managed his own estate by spending from the income or by consuming the capital, and whether, if he had been a ward himself, he would have accepted this account from his guardians, or would have demanded to recover the capital along with the profits that had accrued, to these things he answered nothing, but challenged me, saying he wished to show that my estate was worth ten talents; and if anything was lacking, he said he would add it himself.
§51κελεύοντος δʼ ἐμοῦ πρὸς τὸν διαιτητὴν ἐπιδεικνύναι ταῦτʼ οὐκ ἐπέδειξεν, οὐδʼ ὡς οἱ συνεπίτροποι παρέδοσαν (οὐ γὰρ ἂν αὐτοῦ κατεδιῄτησεν), μαρτυρίαν δʼ ἐνεβάλετο τοιαύτην, περὶ ἧς πειράσεταί τι λέγειν.
But when I urged him before the arbitrator to show this, he did not show it, nor that his co-guardians had delivered it (for otherwise the arbitrator would not have decided against him), but he submitted such a deposition, about which he will attempt to say something.
ἂν μὲν οὖν καὶ νῦν ἔχειν με φῇ, τίνος παραδόντος ἐρωτᾶτʼ αὐτόν, καὶ καθʼ ἕκαστον παρασχέσθαι μάρτυρας ἀξιοῦτε.
If, therefore, he says even now that I have it, ask him who delivered it, and demand that he produce witnesses for each detail.
§52ἐὰν δʼ εἶναί μοι φῇ τοῦτον τὸν τρόπον, λογιζόμενος τὰ παρʼ ἑκατέρῳ τῶν ἐπιτρόπων, διπλασίοις ἐλάττω φανήσεται λέγων, ἔχοντα δʼ οὐδὲν μᾶλλον ἀποφαίνων.
But if he says that it exists for me in this manner, by calculating what is with each of the guardians, he will be shown to be speaking of an amount less by double, and showing no more that I possess it.
ἐγὼ γὰρ ὥσπερ καὶ τοῦτον τοσαῦτʼ ἔχοντʼ ἐξήλεγξα, οὕτως κἀκείνων ἑκάτερον οὐκ ἐλάττω τούτων ἔχοντʼ ἐπιδείξω.
For just as I convicted this man of holding so much, so I shall demonstrate that each of those also holds no less than he does.
ὥστʼ οὐ τοῦτʼ αὐτῷ λεκτέον, ἀλλʼ ὡς ἢ αὐτὸς ἢ οἱ συνεπίτροποι παρέδοσαν.
So he must not say this, but that either he himself or his co-guardians delivered it.
εἰ δὲ μὴ τοῦτʼ ἐπιδείξει, πῶς χρὴ ταύτῃ τῇ προκλήσει προσέχειν ὑμᾶς τὸν νοῦν;
But if he does not demonstrate this, how should you pay attention to this challenge?
οὐδὲν γὰρ μᾶλλον ἔχοντά μʼ ἐπιδείκνυσι.
For he demonstrates no more that I possess it.
§53πολλὰ τοίνυν ἀπορηθεὶς πρὸς τῷ διαιτητῇ περὶ πάντων τούτων, καὶ καθʼ ἕκαστον ἐξελεγχόμενος ὥσπερ νυνὶ παρʼ ὑμῖν, ἐτόλμησε ψεύσασθαι πάντων δεινότατον, ὡς τέτταρά μοι τάλανθʼ ὁ πατὴρ κατέλιπε κατορωρυγμένα καὶ τούτων κυρίαν τὴν μητέρʼ ἐποίησεν.
Having been at a loss, therefore, in many ways before the arbitrator concerning all these things, and being convicted in each detail just as he is now before you, he dared to tell the most terrible lie of all: that my father left me four talents buried in the ground and made my mother mistress of them.
ταῦτα δʼ εἶπεν, ἵνʼ εἰ μὲν καὶ νῦν προσδοκήσαιμʼ αὐτὸν ἐρεῖν, ἀπολογούμενος περὶ αὐτῶν διατρίβοιμι, δέον ἕτερά μʼ αὐτοῦ κατηγορεῖν πρὸς ὑμᾶς· εἰ δʼ ὡς οὐ ῥηθησομένων παραλίποιμι, νῦν αὐτὸς εἴποι, ἵνα δοκῶν εἶναι πλούσιος ἧττον ὑφʼ ὑμῶν ἐλεοίμην.
He said these things so that, if I should expect him to say it even now and spend my time defending myself against it, I might waste time when I ought to be accusing him of other things before you; or if I should pass it over as something that would not be said, he might say it himself now, so that, seeming to be rich, I might be less pitied by you.
§54καὶ μαρτυρίαν μὲν οὐδεμίαν ἐνεβάλετο τούτων ὁ ταῦτʼ εἰπεῖν ἀξιώσας, ψιλῷ δὲ λόγῳ χρησάμενος ὡς πιστευθησόμενος διʼ ἐκείνων.
And he who thought fit to say these things submitted no deposition of them, but used a mere assertion, as if he would be believed through them.
καὶ ὅταν μὲν ἔρηταί τις αὐτόν, εἰς τί τῶν ἐμῶν τοσαῦτα χρήματʼ ἀνήλωκεν, χρέα φησὶν ὑπὲρ ἐμοῦ ἐκτετεικέναι καὶ πένητʼ ἐνταυθοῖ ζητεῖ ποιεῖν· ὅταν δὲ βούληται, πλούσιον ὡς ἔοικεν, εἴπερ γε καὶ τοσοῦτον ἐκεῖνος ἀργύριον οἴκοι κατέλιπεν.
And whenever anyone asks him on what of my things he has spent so much money, he says he has paid debts on my behalf and seeks to make me a poor man here; but whenever he wishes, he makes me rich, as it seems, if indeed my father left so much money at home.
ὡς δʼ οὐκ ἀληθῆ λέγειν οἷόν τʼ αὐτόν, ἀλλʼ ἀδύνατόν τι γενέσθαι τούτων, ἐκ πολλῶν ῥᾴδιον μαθεῖν.
But that it is impossible for him to be speaking the truth, and that any of these things should have happened, is easy to learn from many facts.
