§1εἰ μὲν ἐβούλετʼ Ἄφοβος, ὦ ἄνδρες δικασταί, τὰ δίκαια ποιεῖν ἢ περὶ ὧν διεφερόμεθα τοῖς οἰκείοις ἐπιτρέπειν, οὐδὲν ἂν ἔδει δικῶν οὐδὲ πραγμάτων· ἀπέχρη γὰρ ἂν τοῖς ὑπʼ ἐκείνων γνωσθεῖσιν ἐμμένειν, ὥστε μηδεμίαν ἡμῖν εἶναι πρὸς τοῦτον διαφοράν.
If Aphobus, gentlemen of the jury, had been willing to do what is right, or to refer the matters on which we differed to our relatives, there would have been no need of lawsuits or troubles; for it would have sufficed to abide by their decisions, so that we would have no dispute with him.
ἐπειδὴ δʼ οὗτος τοὺς μὲν σαφῶς εἰδότας τὰ ἡμέτερʼ ἔφυγε μηδὲν διαγνῶναι περὶ αὐτῶν, εἰς δʼ ὑμᾶς τοὺς οὐδὲν τῶν ἡμετέρων ἀκριβῶς ἐπισταμένους ἐλήλυθεν, ἀνάγκη ἐστὶν ἐν ὑμῖν παρʼ αὐτοῦ πειρᾶσθαι τῶν δικαίων τυγχάνειν.
But since he avoided those who knew our affairs clearly, so that they might decide nothing about them, and has come before you who know nothing of our affairs accurately, it is necessary to attempt to obtain justice from him before you.
§2οἶδα μὲν οὖν, ὦ ἄνδρες δικασταί, ὅτι πρὸς ἄνδρας καὶ λέγειν ἱκανοὺς καὶ παρασκευάσασθαι δυναμένους χαλεπόν ἐστιν εἰς ἀγῶνα καθίστασθαι περὶ τῶν ὄντων ἁπάντων, ἄπειρον ὄντα παντάπασι πραγμάτων διὰ τὴν ἡλικίαν· ὅμως δέ, καίπερ πολὺ τούτων καταδεέστερος ὤν, πολλὰς ἐλπίδας ἔχω καὶ παρʼ ὑμῖν τεύξεσθαι τῶν δικαίων καὶ μέχρι γε τοῦ τὰ γεγενημένα διεξελθεῖν καὶ αὐτὸς ἀρκούντως ἐρεῖν, ὥσθʼ ὑμᾶς μήτʼ ἀπολειφθῆναι τῶν πραγμάτων μηδὲ καθʼ ἓν μήτʼ ἀγνοῆσαι περὶ ὧν δεήσει τὴν ψῆφον ἐνεγκεῖν.
Now I know, gentlemen of the jury, that it is difficult to enter into a contest for one's whole fortune against men who are both capable speakers and well-prepared, when one is completely inexperienced in affairs due to one's youth; nevertheless, although I am far inferior to them, I have great hopes that I shall obtain justice before you, and that I myself shall speak adequately at least to set forth what has happened, so that you will neither be left behind in any point of the affairs nor fail to understand the matters on which you must cast your vote.
§3δέομαι δʼ ὑμῶν, ὦ ἄνδρες δικασταί, μετʼ εὐνοίας τέ μου ἀκοῦσαι, κἂν ἠδικῆσθαι δοκῶ, βοηθῆσαί μοι τὰ δίκαια.
I entreat you, gentlemen of the jury, to hear me with goodwill, and, if I seem to have been wronged, to aid me as justice requires.
ποιήσομαι δʼ ὡς ἂν δύνωμαι διὰ βραχυτάτων τοὺς λόγους.
I shall make my speech as brief as I can.
ὅθεν οὖν ῥᾷστα μαθήσεσθε περὶ αὐτῶν, ἐντεῦθεν ὑμᾶς καὶ ἐγὼ πρῶτον πειράσομαι διδάσκειν.
From the point where you will most easily learn about these matters, from there I too will first attempt to instruct you.
§4Δημοσθένης γὰρ οὑμὸς πατήρ, ὦ ἄνδρες δικασταί, κατέλιπεν οὐσίαν μὲν σχεδὸν τεττάρων καὶ δέκα ταλάντων, ἐμὲ δʼ ἕπτʼ ἐτῶν ὄντα καὶ τὴν ἀδελφὴν πέντε, ἔτι δὲ τὴν ἡμετέραν μητέρα πεντήκοντα μνᾶς εἰς τὸν οἶκον εἰσενηνεγμένην.
For my father Demosthenes, gentlemen of the jury, left an estate of nearly fourteen talents, and myself at the age of seven and my sister at five, and furthermore our mother, who had brought a dowry of fifty minae into the household.
βουλευσάμενος δὲ περὶ ἡμῶν, ὅτʼ ἔμελλε τελευτᾶν, ἅπαντα ταῦτʼ ἐνεχείρισεν Ἀφόβῳ τε τουτῳὶ καὶ Δημοφῶντι τῷ Δήμωνος υἱεῖ, τούτοιν μὲν ἀδελφιδοῖν ὄντοιν, τῷ μὲν ἐξ ἀδελφοῦ, τῷ δʼ ἐξ ἀδελφῆς γεγονότοιν, ἔτι δὲ Θηριππίδῃ τῷ Παιανιεῖ, γένει μὲν οὐδὲν προσήκοντι, φίλῳ δʼ ἐκ παιδὸς ὑπάρχοντι.
Having made plans for us when he was about to die, he entrusted all these to this Aphobus here and Demophon, the son of Demon, these two being his nephews, the one born of his brother, the other of his sister, and further to Therippides of Paiania, who was in no way related by blood, but had been his friend from childhood.
§5κἀκείνῳ μὲν ἔδωκεν ἐκ τῶν ἐμῶν ἑβδομήκοντα μνᾶς καρπώσασθαι τοσοῦτον χρόνον, ἕως ἐγὼ ἀνὴρ εἶναι δοκιμασθείην, ὅπως μὴ διʼ ἐπιθυμίαν χρημάτων χεῖρόν τι τῶν ἐμῶν διοικήσειεν· Δημοφῶντι δὲ τὴν ἐμὴν ἀδελφὴν καὶ δύο τάλαντʼ εὐθὺς ἔδωκεν ἔχειν, αὐτῷ δὲ τούτῳ τὴν μητέρα τὴν ἐμὴν καὶ προῖκʼ ὀγδοήκοντα μνᾶς, καὶ τὴν οἰκίαν οἰκεῖν καὶ σκεύεσι χρῆσθαι τοῖς ἐμοῖς, ἡγούμενος, καὶ τούτους ἔτʼ οἰκειοτέρους εἴ μοι ποιήσειεν, οὐκ ἂν χεῖρόν μʼ ἐπιτροπευθῆναι ταύτης τῆς οἰκειότητος προσγενομένης.
And to that man he gave the right to enjoy the interest of seventy minae from my property for such a long time until I should be approved as a man, so that he might not administer my property any worse out of desire for money; and to Demophon he gave my sister and two talents to have immediately, and to this very man my mother and a dowry of eighty minae, and to live in the house and use my furniture, thinking that, if he made these men still closer relatives to me, I would not be worse off under their guardianship, this relationship being added.
§6λαβόντες δʼ οὗτοι ταῦτα πρῶτον σφίσιν αὐτοῖς ἐκ τῶν χρημάτων, καὶ τὴν ἄλλην οὐσίαν ἅπασαν διαχειρίσαντες, καὶ δέκʼ ἔτη ἡμᾶς ἐπιτροπεύσαντες, τὰ μὲν ἄλλα πάντʼ ἀπεστερήκασιν, τὴν οἰκίαν δὲ καὶ ἀνδράποδα τέτταρα καὶ δέκα καὶ ἀργυρίου μνᾶς τριάκοντα, μάλιστα σύμπαντα ταῦτʼ εἰς ἑβδομήκοντα μνᾶς παραδεδώκασι.
But although they received these things first for themselves from the property, and administered all the rest of the estate, and guarded us for ten years, they have deprived us of absolutely everything else, and have handed over only the house, fourteen slaves, and thirty minae in money, which altogether amount to about seventy minae.
§7καὶ τὸ μὲν κεφάλαιον τῶν ἀδικημάτων, ὡς ἂν συντομώτατʼ εἴποι τις, τοῦτʼ ἔστιν, ὦ ἄνδρες δικασταί· τὸ δὲ πλῆθος τῆς οὐσίας ὅτι τοῦτʼ ἦν τὸ καταλειφθέν, μέγιστοι μὲν αὐτοὶ μάρτυρές μοι γεγόνασιν·
And the sum of their wrongdoings, to speak as briefly as possible, is this, gentlemen of the jury; and that this was the amount of the estate left, they themselves have become my greatest witnesses.
εἰς γὰρ τὴν συμμορίαν ὑπὲρ ἐμοῦ συνετάξαντο κατὰ τὰς πέντε καὶ εἴκοσι μνᾶς πεντακοσίας δραχμὰς εἰσφέρειν, ὅσονπερ Τιμόθεος ὁ Κόνωνος καὶ οἱ τὰ μέγιστα κεκτημένοι τιμήματʼ εἰσέφερον·
For on my behalf they registered me in the tax-district to contribute five hundred drachmae for every twenty-five minae, which was as much as Timotheus, the son of Conon, and those possessing the largest valuations contributed.
δεῖ δὲ καὶ καθʼ ἕκαστον ὑμᾶς ἀκοῦσαι τά τʼ ἐνεργὰ αὐτῶν καὶ ὅσʼ ἦν ἀργὰ καὶ ὅσου ἦν ἄξιʼ ἕκαστα.
But you must also hear about each item, both those that were active and those that were inactive, and how much each was worth.
ταῦτα γὰρ μαθόντες ἀκριβῶς εἴσεσθε, ὅτι τῶν πώποτʼ ἐπιτροπευσάντων οὐδένες ἀναιδέστερον οὐδὲ περιφανέστερον ἢ οὗτοι τὰ ἡμέτερα διηρπάκασιν.
For having learned these things accurately, you will know that of all those who have ever acted as guardians, none have plundered our property more shamelessly or more conspicuously than these men.
