§12.1οὕτω δὲ περὶ ταῦτα δημοτικὸς γενόμενος νομοθέτης καὶ μέτριος, ἐν τῷ μὴ μετρίῳ τὴν τιμωρίαν ὑπερέτεινεν.
Thus having shown himself a democratic and moderate lawgiver in these matters, in one immoderate thing he stretched the punishment to excess.
ἔγραψε γὰρ νόμον ἄνευ κρίσεως κτεῖνια διδόντα τὸν βουλόμενον τυραννεῖν κτείναντα δὲ φόνου καθαρὸν ἐποίησεν, εἰ παράσχοιτο τοῦ ἀδικήματος τοὺς ἐλέγχους.
For he enacted a law giving the right to kill without trial anyone who wished to play the tyrant, and made the killer free from the guilt of murder, if he provided proofs of the crime.
ἐπεὶ γὰρ οὐ δυνατὸν ἐπιχειροῦντα τηλικούτοις λαθεῖν ἅπαντας, οὐκ ἀδύνατον δὲ τὸ μὴ λαθόντα τοῦ κριθῆναι φθάσαι κρείττονα γενόμενον, ἣν ἀναιρεῖ τὸ ἀδίκημα κρίσιν, προλαβεῖν ἔδωκε τῷ δυναμένῳ κατὰ τοῦ ἀδικοῦντος.
For since it is not possible for one attempting such great deeds to escape everyone's notice, and it is not impossible for one who did not escape notice, by becoming too powerful, to forestall being judged—which trial the crime itself destroys—he gave the right to anticipate the wrongdoer to anyone who had the power.
§12.2ἐπῃνέθη δὲ καὶ διὰ τὸν ταμιευτικὸν νόμον.
And he was also praised for his treasury law.
ἐπεὶ γὰρ ἔδει χρήματα πρὸς τὸν πόλεμον εἰσενεγκεῖν ἀπὸ τῶν οὐσιῶν τοὺς πολίτας, οὔτʼ αὐτὸς ἅψασθαι τῆς οἰκονομίας οὔτε τοὺς φίλους ἐᾶσαι βουλόμενος οὔθʼ ὅλως εἰς οἶκον ἰδιώτου παρελθεῖν δημόσια χρήματα, ταμιεῖον μὲν ἀπέδειξε τὸν τοῦ Κρόνου ναόν, ᾧ μέχρι νῦν χρώμενοι διατελοῦσι, ταμίας δὲ τῷ δήμῳ δύο τῶν νέων ἔδωκεν ἀποδεῖξαι· §12.3καὶ ἀπεδείχθησαν οἱ πρῶτοι Πούπλιος Ο ὐετούριος καὶ Μινούκιος Μᾶρκος καὶ χρήματα συνήχθη πολλά, τρισκαίδεκα γὰρ ἀπεγράψαντο μυριάδες, ὀρφανοῖς παισὶ καὶ χήραις γυναιξὶν ἀνεθείσης τῆς εἰσφορᾶς.
For since the citizens had to contribute money for the war from their estates, and he wished neither to touch the administration of it himself nor to allow his friends to do so, nor indeed that public money should enter a private house at all, he designated the temple of Saturn as the treasury, which they continue to use to this day, and he gave the people the right to appoint two of the young men as treasurers; and the first appointed were Publius Veturius and Marcus Minucius. And much money was collected; for one hundred and thirty thousand citizens registered themselves, the contribution being remitted for orphan children and widowed women.
§12.4ταῦτα δὲ διοικήσας ἀπέδειξεν ἑαυτῷ συνάρχοντα τὸν Λουκρητίας πατέρα Λουκρήτιον, ᾧ τῆς ἡγεμονικωτέρας ἐξιστάμενος ὄντι πρεσβυτέρῳ τάξεως παρέδωκε τοὺς καλουμένους φάσκης καὶ τοῦτο διέμεινεν εἰς ἡμᾶς τὸ πρεσβεῖον ἀπʼ ἐκείνου τοῖς γεραιτέροις φυλαττό μενον.
Having arranged these things, he appointed as his colleague Lucretius, the father of Lucretia, to whom, as he was older, yielding the more honorable rank, he handed over the so-called fasces; and this privilege of honor has remained down to our day, preserved from that time for the older colleague.
ἐπεὶ δʼ ὀλίγαις ἡμέραις ὕστερον ἐτελεύτησεν ὁ Λουκρήτιος, πάλιν ἀρχαιρεσιῶν γενομένων ᾑρέθη Μᾶρκος Ὡράτιος, καὶ συνῆρχε τῷ Ποπλικόλᾳ τὸν ὑπολειπόμενον χρόνον τοῦ ἐνιαυτοῦ.
And when Lucretius died a few days later, elections being held again, Marcus Horatius was chosen, and he was colleague to Publicola for the remaining time of the year.
