[같은 저자, 『고시 주해』 제49권] 라베오는 물을 탐색하고 발견된 물을 끌어오는 것이 허용된다는 그러한 지역권을 설정하는 것이 가능하다고 말한다. 왜냐하면 아직 건물이 건축되지 않았음에도 지역권을 설정하는 것이 허용된다면, 왜 아직 물이 발견되지 않았음에도 마찬가지로 그러한 지역권을 설정하는 것이 허용되지 않겠는가? 그리고 탐색이 허용되도록 [권리를] 양도할 수 있다면, 발견된 물이 끌어와지도록 하는 것 또한 양도될 수 있다.
