§42.5.22.1Sed si bonis curator datus sit uel absentis uel ab hostibus capti uel dum deliberant scripti heredes de adeunda hereditate, non oportebit priuilegium dari: non enim in eadem causa est.
But if a curator has been appointed for the property either of an absent person, or of one captured by enemies, or while the instituted heirs are deliberating on entering upon the inheritance, the privilege ought not to be granted; for it is not in the same case.
