[PAULUS, in the first book on the Edict.] For whatever reason, one who has been summoned to court before the praetor or others who preside over jurisdiction must appear, in order that this very thing may be known, whether he has jurisdiction.
§2.5.2.1Si quis in ius uocatus non ierit, ex causa a competenti iudice multa pro iurisdictione iudicis damnabitur: rusticitati enim hominis parcendum erit: item si nihil intersit actoris eo tempore in ius aduersarium uenisse, remittit praetor poenam, puta quia feriatus dies fuit.
If anyone, having been summoned to court, has not gone, he shall, upon cause shown, be condemned to a fine by the competent judge in proportion to the jurisdiction of the judge: for allowance must be made for the rustic simplicity of the person: likewise, if it is of no concern to the plaintiff that the adversary appeared in court at that time, the praetor remits the penalty, for instance, because it was a holiday.
