[ULPIANUS, Book 33 on the Edict.] If the oath has not been remitted by the one who tendered it, but there is no swearing regarding false accusation, it is a consequence that the action ought to be denied to him; for he who proceeded to the tender of the oath and did not previously swear regarding false accusation should hold himself responsible, so that this person may be like one who remits it.
