[PAULUS, from the tenth book on Sabinus.] When a slave holds something, the master is liable in his own name for production; but if the slave, without the knowledge of the master, has acted with malicious intent to avoid having it, either an action for theft or one for fraud must be granted as a noxal action on account of the slave, whereas no analogous action for production should be established.
