[PAULUS, from the twelfth book on Sabinus.] If an action for the partition of an inheritance, for the division of common property, or for the regulation of boundaries has been brought, and one of the litigants dies leaving several heirs, the trial cannot be split into parts, but either all the heirs must accept the trial, or they must appoint a single procurator against whom the action may be conducted in the name of all.
