§1αἴτιος μέν ἐστι Λεωχάρης οὑτοσί, ὦ ἄνδρες δικασταί, τοῦ καὶ αὐτὸς κρίνεσθαι καὶ ἐμὲ νεώτερον ὄντα λέγειν ἐν ὑμῖν, ἀξιῶν κληρονομεῖν ὧν οὐ προσῆκεν αὐτῷ, καὶ ὑπὲρ τούτων ψευδῆ διαμαρτυρίαν πρὸς τῷ ἄρχοντι ποιησάμενος.
Leochares here, gentlemen of the jury, is the cause both of his own trial and of my speaking before you, young as I am, because he claims to inherit what does not belong to him, and has made a false protestation before the archon concerning these matters.
§2ἡμῖν μὲν γὰρ ἀναγκαῖον ἦν, τοῦ νόμου τὰς ἀγχιστείας τοῖς ἐγγυτάτω γένους ἀποδιδόντος, οὖσιν οἰκείοις Ἀρχιάδου τοῦ ἐξ ἀρχῆς καταλιπόντος τὸν κλῆρον, μήτε τὸν οἶκον ἐξερημωθέντα τὸν ἐκείνου περιιδεῖν μήτε τῆς οὐσίας ἑτέρους κληρονομήσαντας, οἷς οὐδʼ ὁτιοῦν προσήκει·
For since the law awards the right of succession to the next of kin, it was necessary for us, who are relatives of Archiades, the original owner who left the estate, neither to allow his house to be left desolate, nor to see others inherit his property who have no claim whatsoever to it.
οὑτοσὶ δὲ οὔτε γόνῳ τοῦ τετελευτηκότος υἱὸς ὢν οὔτʼ εἰσποιηθεὶς κατὰ τοὺς νόμους, ὡς ἐγὼ δείξω, διαμεμαρτύρηκεν οὕτως τὰ ψευδῆ προπετῶς, ἀφαιρούμενος ἡμῶν τὴν κληρονομίαν.
But this man, though he is neither a son of the deceased by birth, nor has been adopted according to the laws, as I shall demonstrate, has thus rashly made a false protestation, attempting to deprive us of the inheritance.
§3δέομαι δʼ ὑμῶν, ὦ ἄνδρες δικασταί, βοηθῆσαι τῷ τε πατρὶ τούτῳ καὶ ἐμοί, ἐὰν λέγωμεν τὰ δίκαια, καὶ μὴ περιιδεῖν πένητας ἀνθρώπους καὶ ἀσθενεῖς καταστασιασθέντας ὑπὸ παρατάξεως ἀδίκου.
Therefore, gentlemen of the jury, I beg of you to assist both this father of mine and myself, if we speak what is just, and not to allow poor and weak men to be crushed by an unjust combination.
ἡμεῖς μὲν γὰρ ταῖς ἀληθείαις πιστεύοντες εἰσεληλύθαμεν, καὶ ἀγαπῶντες, ἄν τις ἡμᾶς ἐᾷ τῶν νόμων τυγχάνειν· οὗτοι δὲ τῇ παρασκευῇ καὶ τοῖς ἀναλώμασιν ἰσχυριζόμενοι διατετελέκασιν, εἰκότως οἶμαι· ἐκ γὰρ τῶν ἀλλοτρίων ῥᾳδίως ἀναλίσκουσιν, ὥστε καὶ τοὺς συνεροῦντας ὑπὲρ αὑτῶν καὶ τοὺς μαρτυρήσοντας τὰ ψευδῆ πολλοὺς πεπορίσθαι.
For we have entered court trusting in the truth, and well-content if anyone permits us to obtain our legal rights; but these men have continually relied on their intrigues and expenditure—naturally enough, I suppose, since they spend easily from what belongs to others, so that they have provided themselves with many who will speak on their behalf and bear false witness.
§4ὁ δὲ πατὴρ οὗτος (εἰρήσεται γάρ) ἅμα τῆς πενίας ἧς ὑμεῖς ἅπαντες ἴστε, καὶ τοῦ ἰδιώτης εἶναι φανερὰς ἔχων τὰς μαρτυρίας ἀγωνίζεται· διατελεῖ γὰρ ἐν Πειραιεῖ κηρύττων·
This father of mine (for the truth shall be told) is conducting his case with obvious proofs both of the poverty which you all know of, and of his being an untrained layman; for he continually works as a public crier in Peiraeus.
τοῦτο δʼ ἐστὶν οὐ μόνον ἀπορίας ἀνθρωπίνης τεκμήριον, ἀλλὰ καὶ ἀσχολίας τῆς ἐπὶ τὸ πραγματεύεσθαι· ἀνάγκη γὰρ ἡμερεύειν ἐν τῇ ἀγορᾷ τὸν τοιοῦτον.
This is a token not only of human need, but also of a lack of leisure for litigation; for such a man must spend his day in the marketplace.
ἃ δεῖ λογιζομένους ἐνθυμεῖσθαι ὅτι, εἰ μὴ τῷ δικαίῳ ἐπιστεύομεν, οὐκ ἄν ποτʼ εἰσήλθομεν εἰς ὑμᾶς.
Taking these things into account, you must reflect that, if we did not trust in the justice of our cause, we would never have come before you.
§5περὶ μὲν οὖν τῶν τοιούτων καὶ προϊόντος τοῦ λόγου σαφέστερον ἀκούσεσθε· ὑπὲρ αὐτῆς δὲ τῆς διαμαρτυρίας καὶ τοῦ ἀγῶνος ἤδη νομίζω δεῖν διδάσκειν.
Now, about these matters you will hear more clearly as the speech proceeds; but I think I must now instruct you concerning the protestation itself and the suit.
εἰ μὲν οὖν, ὦ ἄνδρες δικασταί, ἐκ τῆς διαμαρτυρίας αὐτῆς Λεωχάρης ἔμελλεν ἀπολογούμενος δείξειν ὡς ἔστιν υἱὸς γνήσιος Ἀρχιάδου, οὐδὲν ἂν ἔδει πολλῶν λόγων, οὐδʼ ἄνωθεν ὑμᾶς ἐξετάζειν τὸ γένος τὸ ἡμέτερον· §6ἐπειδὴ δὲ τὰ μὲν διαμεμαρτυρημένα ἕτερον τρόπον ἔχει, ὁ δὲ πολὺς τοῦ λόγου τουτοισὶ ἔσται ὡς εἰσεποιήθησαν, καὶ κατὰ τὴν ἀγχιστείαν γνήσιοι ὄντες δικαίως ἂν τῆς οὐσίας κληρονομοῖεν, ἀναγκαῖον, ὦ ἄνδρες δικασταί, διὰ ταῦτα μικρῷ ἄνωθεν τὰ περὶ τοῦ γένους ὑμῖν διεξελθεῖν· ἐὰν γὰρ τοῦτο σαφῶς μάθητε, οὐ μὴ παρακρουσθῆτε ὑπʼ αὐτῶν τῷ λόγῳ.
If, then, gentlemen of the jury, Leochares were going to show in his defense from the protestation itself that he is a legitimate son of Archiades, there would be no need of many words, nor of examining our pedigree from of old; but since the facts attested in their protestation are otherwise, and the main part of their argument will be that they were adopted, and that being legitimate according to the right of kinship they would justly inherit the estate, it is necessary, gentlemen of the jury, for these reasons to set before you the details of our pedigree from a little further back; for if you learn this clearly, you will certainly not be misled by their arguments.
§7ἔστιν γὰρ ὁ μὲν ἀγὼν οὑτοσὶ κλήρου διαδικασία, ἀμφισβητεῖται δὲ παρὰ μὲν ἡμῶν κατὰ γένος ἡ ἀγχιστεία, παρὰ δὲ τούτων κατὰ ποίησιν·
For this lawsuit is a claim to an estate, and the right of succession is contested by us on the ground of kinship, and by them on the ground of adoption.
ὁμολογοῦμεν δʼ ἐναντίον ὑμῶν δεῖν τὰς ποιήσεις κυρίας εἶναι, ὅσαι ἂν κατὰ τοὺς νόμους δικαίως γένωνται.
We acknowledge before you that all adoptions ought to be valid which are made justly and in accordance with the laws.
ὥστε ταύτας τὰς ὑποθέσεις μεμνημένοι, ἂν δείξωσιν ὑμῖν διδόντας τοὺς νόμους αὑτοῖς ἃ διαμεμαρτυρήκασιν, ψηφίσασθε αὐτοῖς τὸν κλῆρον.
Therefore, keeping these premises in mind, if they show you that the laws grant them what they have attested in their protestation, vote the estate to them.
§8καὶ ἐὰν ἐκ μὲν τῶν νόμων μὴ ὑπάρχῃ, δίκαια δὲ καὶ φιλάνθρωπα φαίνωνται λέγοντες, καὶ ὣς συγχωροῦμεν.
And even if it is not supported by the laws, but they appear to speak what is just and reasonable, we agree to yield even so.
ἵνα δὲ εἰδῆτε ὅτι κατὰ γένος ἐγγύτατα ὄντες οὐ μόνον τούτῳ ἐνισχυριζόμεθα, ἀλλὰ καὶ τοῖς ἄλλοις ἅπασιν, πρῶτον μὲν ὑπὲρ αὐτοῦ τοῦ γένους ὑμᾶς διδάξομεν, ὅθεν ἐστὶν ὁ κλῆρος· νομίζω γάρ, ἂν τούτῳ τῷ μέρει τοῦ ἀγῶνος σαφῶς παρακολουθήσητε, καὶ τῶν ἄλλων ὑμᾶς οὐδενὸς ἀπολειφθήσεσθαι.
But in order that you may know that we, being the next of kin by blood, do not rely on this alone, but on all other grounds as well, we shall first instruct you about the pedigree itself, from which the estate is derived; for I think that if you follow this part of the case clearly, you will not fail to grasp any of the remaining points.
§9τὸ γὰρ ἐξ ἀρχῆς, ὦ ἄνδρες δικασταί, γίγνονται Εὐθυμάχῳ τῷ Ὀτρυνεῖ υἱεῖς τρεῖς, Μειδυλίδης καὶ Ἄρχιππος καὶ Ἀρχιάδης, καὶ θυγάτηρ ᾗ ὄνομα ἦν Ἀρχιδίκη.
In the beginning, gentlemen of the jury, to Euthymachus of Otryne were born three sons, Meidylides, Archippus, and Archiades, and a daughter whose name was Archidice.
τελευτήσαντος δὲ τοῦ πατρὸς αὐτοῖς, τὴν μὲν Ἀρχιδίκην ἐκδιδόασιν Λεωστράτῳ Ἐλευσινίῳ, αὐτῶν δὲ τριῶν ὄντων ὁ μὲν Ἄρχιππος τριηραρχῶν ἐτελεύτησεν τὸν βίον ἐν Μηθύμνῃ, ὁ δὲ Μειδυλίδης οὐ πολλῷ χρόνῳ γαμεῖ ὕστερον Μνησιμάχην Λυσίππου τοῦ Κριωέως θυγατέρα.
After their father died, they gave Archidice in marriage to Leostratus of Eleusis; and of the three brothers, Archippus died at Methymna while serving as trierarch, and Meidylides, not long afterwards, married Mnesimache, the daughter of Lysippus of Crioa.
