[THE SAME, Book 40.] A person to whom the entire inheritance, and besides this a tract of land, has been left by way of fideicommissum, if he has given ten to the heir, and the heir has declared the inheritance to be suspect and has restored it in accordance with the Senatusconsultum Trebellianum, has no cause for giving the money; and therefore, because he gave it on that account, as if for the sake of fulfilling a condition, he shall recover it by an action for recovery (condictio).
