[ULPIANUS, Book XIX on the Edict.] This action relates to rustic estates, even though buildings are situated between them; for it makes no great difference whether one places trees or a building on the boundary.
§10.1.2.1Iudici finium regundorum permittitur, ut, ubi non possit dirimere fines, adiudicatione controuersiam dirimat: et si forte amouendae ueteris obscuritatis gratia per aliam regionem fines dirigere iudex uelit, potest hoc facere per adiudicationem et condemnationem.
The judge in an action for establishing boundaries is permitted, when he cannot determine the boundaries, to settle the dispute by adjudication; and if by chance, for the sake of removing ancient obscurity, the judge should wish to direct the boundaries through another area, he can do this through adjudication and condemnation.
