§4.4.22.pr

Effects of Restitution Regarding Minor's Inheritance

This passage states an imperial rescript clarifying that a minor seeking restitution against inheritance acceptance is not liable to refund legacies or the value of freed slaves, and conversely, acts of a curator appointed to sell assets remain valid when a minor is restored to accept an inheritance.

§4.4.22.pr

In integrum uero restitutione postulata1 aduersus aditionem a minore factam, si quid legatis expensum est, uel pretia eorum qui ad libertatem aditione eius peruenerunt, a minore refundenda non sunt. quemadmodum per contrarium cum minor restituitur ad adeundam hereditatem, quae antea gesta erant per curatorem bonorum decreto praetoris ad distrahenda bona secundum iuris formam constitutum,2 rata esse habenda3 Calpurnio Flacco Seuerus et Antoninus rescripserunt.

But when restitution in integrum has been petitioned for against an acceptance of an inheritance made by a minor, if anything has been paid out for legacies, or the value of those who attained freedom by his acceptance, they do not have to be refunded by the minor. Conversely, when a minor is restored to accept an inheritance, Severus and Antoninus wrote back to Calpurnius Flaccus that what had previously been done by a curator of property appointed by a decree of the praetor to sell the property according to the form of law must be held valid.

Syntax notes3 items
  1. 4.4.22.prrestitutione postulata

An ablative absolute construction consisting of the noun restitutione and the perfect passive participle postulata, expressing a condition or circumstance.

  2. 4.4.22.prconstitutum

A perfect passive participle in the masculine accusative singular, qualifying the noun curatorem. Although it is placed within the clause of the relative pronoun quae, the entire phrase per curatorem bonorum ... constitutum functions as a single prepositional phrase meaning "through the curator of property appointed..."

  3. 4.4.22.prrata esse habenda

An accusative-with-infinitive construction dependent on the main verb rescripserunt. Since the subject is the omitted antecedent of the relative clause quae antea gesta erant (an implied neuter plural accusative like ea), the adjective rata and the gerundive habenda are inflected in the neuter plural accusative.
